New York Judge Hands Trump’s Legal Team a Post-Election Victory

President-elect Donald Trump just secured a post-election victory in one of his legal cases. In DA Alvin Bragg’s Manhattan case against Trump, the judge granted a stay, delaying the decision to toss Trump’s conviction based on the U.S. Supreme Court’s recent ruling that a President is immune from prosecution for “official acts” while in office.

Trump’s legal team had requested a stay in the New York case “based on the impact of this proceeding from the results of the Presidential election.” So the judge granted the request, and we will likely have a decision on Trump’s conviction around Thanksgiving.

ACLJ Senior Counsel and Director of Policy Harry Hutchison explained how the presidential election will likely affect the outcome of Trump’s Manhattan case:

I could foresee this case simply going away, but the case really starts – and the problems start – with judicial malpractice by Judge Merchan. He allowed into evidence contested evidence, with respect to Donald Trump’s core presidential powers. And that particular decision came into full relief after the Supreme Court’s decision in the Trump v. United States case, basically disallowing or providing constitutional immunity to Presidents for core “official acts” and a limited or presumptive immunity with respect to other “official acts.” So . . . the jurors heard this and, therefore, they reached their verdict on the basis of contested evidence.

And so I think a constitutional lawyer would argue that this case ought to disappear. Now, that’s a tough decision. It implicates both the judge and the prosecution in this case. . . . At the end of the day, the judge might decide simply to defer any judgment until . . . after President Trump has served his full four-year term.

President Trump could also appeal the judge’s decision if the conviction is upheld. Regardless of what happens, it’s hard to see Trump getting sentenced to prison.

We’ve already seen how Special Counsel Jack Smith has announced that he is looking to wind down his federal indictments against President Trump. Smith’s two cases against Trump include the classified documents case (in which a federal judge had already ruled that Smith’s appointment was unconstitutional) and his Jan. 6 superseding indictment. And those two cases should be ending soon.

The abuse of using taxpayer-funded Special Counsels to go after political opponents needs to stop. Special Counsels have prosecuted President Trump for almost eight years now. The election results signify that the American people are ready to move forward from the endless political prosecutions.

Last week a mob sadistically attacked Israeli soccer fans in Amsterdam. A “Jew Hunt” commenced with Israelis being chased by attackers wielding knives and bats. ACLJ Senior Counsel for International and Government Affairs Jeff Ballabon called in from our Jerusalem office to react to the public assault on Jews:

We’ve been watching terrible things around the streets of the world, [crowds] chanting “Kill the Jews,” crime against Jews has been up everywhere, including the U.S. I think that for a lot of us, especially people who grew up in Holocaust families, but even for people who are just aware of the not-so-distant past, seeing these things happen in the heart of where the Holocaust took place, seeing these things happen in Anne Frank’s city. It’s a level of actual trauma – it just triggers trauma.

As a result of the horrific event, many security precautions are being put in place to protect Jews in Paris at an upcoming soccer match. So far, 4,000 additional security forces have been assigned inside and outside the soccer stadium. We are thankful that European countries are seeking to avoid another anti-Israel assault.

The ACLJ fears that the Biden-Harris Administration will completely betray Israel before its term is up. And the International Criminal Court is still trying to issue arrest warrants for Prime Minister Benjamin Netanyahu.

That’s why the ACLJ is filing a vital amicus brief before the international court in defense of Israel. And just days ago, we sent a demand letter to the U.N. Security Council to protect Israel’s interests. The ACLJ will never stop defending Israel.
