Judge Orders Divorce Attorney To Take the Stand Immediately in Fani Willis Case
The saga continues for Fulton County District Attorney Fani Willis and Special Prosecutor Nathan Wade. The judge in the case has ordered that Wade’s divorce attorney, Terrence Bradley, testify about the couple’s relationship. Will the testimony impact the judge’s decision on whether DA Willis will be disqualified from her case against President Donald Trump for alleged 2020 election interference?
The judge presiding over Fulton County District Attorney Fani Willis’ case announced Monday that the former law partner of special prosecutor Nathan Wade will have to testify in court on his knowledge of the timeline of the intimate relationship between Willis and Wade.
Defense counsel claimed the ex-law partner, Terrence Bradley, had direct knowledge that Willis and Wade’s relationship started before Wade was hired in the election interference case involving former President Donald Trump. The testimony of Bradley, who is also Wade’s former divorce lawyer, is expected to resume Tuesday afternoon.
The judge’s decision came after an in-camera hearing Monday with Bradley and his lawyer, after the judge previously said it appeared Bradley may have been misusing his attorney-client privilege.
So after the closed-door meeting between the judge and Bradley yesterday, the judge has moved forward with putting Bradley on the stand. Wade’s divorce attorney won’t be violating any attorney-client privilege by testifying – in fact, he must testify because of his pertinent testimony.
We still don’t know if Willis and Wade will appear again on the stand. Remember that cellphone records came out last week and directly contradicted their claims about when their relationship began. They could face charges of perjury for lying under oath – a felony under Georgia law.
Here’s a lesson that should be learned from this debacle in Georgia: Don’t prosecute ridiculous cases because you could end up in trouble. You better be prosecuting a real case and not just trying to get attention because you could end up with unwanted attention from the defense attorneys.
Wade had no experience as a RICO prosecutor, but Willis brought him in for almost $700,000 to prosecute the RICO charges against President Trump and 18 other individuals. Such questionable decision-making shifted the focus to the prosecutors – and then things spiraled out of control. Now they could face a perjury charge.
If the judge ends up disqualifying Willis, the entire legal team will be removed from the Trump case. Governor Kemp will then appoint a new prosecutor with the authority to pursue or dismiss the case. He could decide that having to start from scratch so close to the election might make the case not worth trying.
Let me update you on the latest cases involving Trump at the U.S. Supreme Court. We are expecting a ruling on our fight to defend your right to vote for the candidate of your choice at any time. We definitely expect a ruling before Super Tuesday, which is next week. The country needs to know if the former President will be on the ballot by then.
If the case were unanimous, we likely would have had an opinion issued by now. One of the Justices could be writing a concurrent or a dissent, which takes time. All this to say, the Justices’ decision could still be unanimous.
But what’s also unexpected is the lack of movement involving President Trump’s appeal to the Supreme Court over presidential immunity. Most would have expected to hear some kind of reaction from the Justices in this case by now as well – either a grant or a denial of a stay. We could be looking at a dissent from the denial, and the Justices turned it into a cert petition and are drafting a question. So now we just wait to see what happens.
