With just weeks until Election Day, Special Counsel Jack Smith has resurfaced again to take down President Donald Trump. He just filed his latest response in the January 6 federal election interference case, contesting President Trump’s motion to dismiss.

We told you about a recent brief that Smith filed detailing the latest charges in his superseding indictment of Trump following the U.S. Supreme Court’s decision to reject Smith’s initial federal election interference charge. Most of it involved hearsay regarding Trump’s interactions with his advisors and Vice President Pence.

Today’s latest development is likely Smith’s last push to take down Trump before Americans go to the voting booths. The Hill reports:

Special counsel Jack Smith on Wednesday contested an effort by former President Trump to toss his Jan. 6 prosecution citing the Supreme Court’s ruling in favor of a Jan. 6 rioter facing one of the same charges. . . .

“The defendant’s supplement ignores entirely that the superseding indictment includes allegations that involve the creation of false evidence,” Smith’s team wrote.

“Contrary to the defendant’s claim … that he bears no factual or legal responsibility for the ‘events on January 6,’ the superseding indictment plainly alleges that the defendant willfully caused his supporters to obstruct and attempt to obstruct the proceeding by summoning them to Washington, D.C., and then directing them to march to the Capitol to pressure the Vice President and legislators to reject the legitimate certificates and instead rely on the fraudulent electoral certificates.”

I’ve been very honest about my feelings on the events of Jan. 6. Much went wrong that day, leaving a deep emotional bruising that has been tough for the country to overcome. At the same time, I don’t see how you can blame organizers of events for the wrong actions of select individuals.

Let’s say that during the March for Life, 100 people from the march were to storm the U.S. Capitol. Are we to blame the organizers of the largest pro-life rally for the actions of 100 protestors who acted on their own? Of course, those who do illegal activity on their own should be lawfully prosecuted, but you couldn’t blame the March for Life organizers.

We must maintain the right to protest peacefully in America. Look at all the peaceful protests that have taken place in our nation’s history. The right to peaceful protest is a First Amendment right that must be preserved.

With Smith’s latest stunt, we are seeing an example of politics superseding the law. We are 20 days from the 2024 presidential election – early voting is well underway. In fact, Georgia broke the record yesterday in early voting. It is blatant election interference for Smith to be proceeding in his political prosecution of President Trump.

Smith’s election interference is so obvious that even CNN’s legal analyst Elie Honig is calling him out. Former Acting Director of National Intelligence Ric Grenell also reacted to Smith’s election interference:

When you read this latest last-breath attempt from Jack Smith to throw mud and politics into the presidential race – this clear election interfering – Jack Smith is just simply Adam Schiff with a beard. They are the same person. They are doing the same thing, which is all made-up politics all of the time. And we’ve got to really push back. We can’t have this election interfering. Jack Smith has had more cases thrown out over his career than he has finished. He’s got a terrible track record of playing politics and getting overturned, and he’s just grasping at straws.

To Ric’s point, Smith has a spectacular record in losing cases after getting them in court on trumped-up charges. He knows this case likely has zero chance of resulting in a conviction, but he is doing everything he can to get negative press against President Trump before the election.
