DOJ Drops Politically Timed Indictment Against Hamas Leaders After Another American Hostage Was Killed

After years of deadly attacks against Israel and nearly a year since the horrific events of October 7 that resulted in thousands of innocent Israeli deaths, the U.S. Department of Justice (DOJ) has charged Yahya Sinwar and five other Hamas leaders with terrorism. But three of those leaders are already dead. The charges are clearly politically timed, coming just days after the bodies of six hostages were found in Gaza.

ACLJ Senior Counsel and Director of Policy Harry Hutchison joined us with his assessment of the DOJ indictment:

Keep in mind that the DOJ filed these charges in February of this year. They unsealed the indictment two months before a national election. So, what the DOJ is trying to do, what the White House is trying to do, what the Biden-Harris Administration is trying to do is to show that they are tough when it’s precisely the opposite of the truth. Israel will indeed go after these terrorists and, in fact, has already done so. But the United States has been reluctant to do so, in part because the United States still blames Israel, at least in part for the October 7th attack. So, we have a situation where a terrorist group attacks Israel, and then we put the blame on the United States and that approach is quite consistent with the Democrats’ Left-wing base. So essentially Israel is blamed when it is attacked.

We at the ACLJ have been begging the government to do something about this for decades. Whether you support President Trump or not, we saw good thing happen in the Middle East during Trump’s Administration, including the Taylor Force Act, the Abraham Accords, and moving the U.S. embassy from Tel Aviv to Jerusalem. Then you have the Biden Administration undo many of those things, weakening our relationship with Israel, and Israel’s relationship with the Gulf states. And as we’ve told you before, the Biden Administration halted a supply of weapons to Israel and withheld war-ending intel from Israel.

This is a little too late and is likely a symbolic indictment. Only two months before the election, the Biden-Harris Administration is trying to appear strong before Hamas. But President Joe Biden is still trying to pressure Israel into signing a ceasefire with Hamas. And the Harris-Walz policy platform is pushing for a ceasefire instead of facing the truth. It’s all about appearances. But the reality is, the U.S. government has funded a terrorist organization. A Vanderbilt Grad student was killed in Israel, and the U.S. responded by rewarding Hamas financially. They’ve funded Iran, and U.N. relief organizations have been working with Hamas in Gaza.

While the Biden-Harris Administration chases political expediency, the ACLJ remains steadfast in our support of Israel. We’re taking aggressive legal action at the U.N., on Capitol Hill, and with world leaders, defending Israel’s legitimacy and right to defend itself in cases across the U.S. And we just sent a critical demand letter to the U.N. Security Council in defense of Israel’s interests. Our filing at the ICC could be the most important legal action we’ve ever taken to defend Israel.

The ACLJ is also at work defending your religious liberty and winning. We’ve had several individuals contact us recently who were unable to attend church because they were denied changes to their work schedules. We even take on large organizations, like the USPS and TSA, to get accommodations for our clients and can often resolve these matters without going to court. Sometimes all it takes is a conversation to clarify the standard:

The Supreme Court has held that employers must make a good faith effort to arrange the employee’s schedule so that he can keep the Sabbath. The employer violates Title VII if it has “made no real effort” in accommodating the employee or has taken a “don’t care” attitude to the request for religious accommodation. because they are required to accommodate individuals to take Sundays off.
