Plea Deal Rejected by Far-Left Congresswoman

The Justice Department has officially charged Rep. LaMonica McIver (NJ-10) with assault and impeding the job of a federal officer after she attacked ICE agents outside an illegal immigration detention facility. McIver also rejected the DOJ’s plea deal offer.
So the initial political stunt occurred on May 9 for the far Left to get their photo op while protesting President Trump’s immigration policies. And as of today, the stunt has gone even further.
If the dissenting Members of Congress and Newark Mayor Ras Baraka had truly wanted to conduct oversight, they could have made an appointment to visit the facility. Yet they wanted to pull a political stunt, forcing their way in.
Though the trespassing charges have been dropped against the Newark mayor, U.S. Attorney for the District of New Jersey Alina Habba is fully going after Rep. McIver. And McIver prolonged the political stunt to make a name for herself by rejecting the DOJ’s plea deal.
McIver’s stunt is not much different than when Rep. Alexandria Ocasio-Cortez (NY-14) visited the border and shed tears. We’ve all seen this kind of outrageous behavior before and aren’t surprised by it. The recent antics of Rep. Jasmine Crockett (TX-30), who called for violence against Tesla CEO Elon Musk, also come to mind.
You can protest in America, but you can’t cause chaos or harm others. McIver crossed the line when she assaulted a federal officer. Also, a sitting congresswoman should be a better example for her constituents because one of her acolytes could do something much worse.
It will be interesting to see the fallout for McIver now that the DOJ has gotten fully involved. We will keep you updated.
In ACLJ-related news, we have a brand-new religious liberty case. Our latest client is a 5th grader with special needs. She had written out Bible verses on strips of paper to share with her classmates. Unfortunately, the school principal confiscated the Bible verses, leaving our client heartbroken and confused.
The student’s foster mother contacted the school and was told conflicting messages. In the process, the school officials lied to our client and emotionally abused her. Above all, the girl’s religious liberties were violated. The ACLJ has taken action on her behalf.
On May 15, the principal again contacted the student’s mother, stating that school district policy prohibits all distribution of religious material on school property at any time. However, despite repeated requests, the principal did not provide the specific policy that would justify this total ban, instead directing the mother to the school district website. The cited policy, “Non-school Materials From Students,” requires prior approval from the principal before any non-school material is distributed, a standard that conflicts with established religious liberty under the First Amendment.
This policy violates settled Supreme Court precedent, which says that students do not shed their religious liberties at the “schoolhouse gate,” and the Establishment Clause, as it would require the principal – in this case, an agent of the government – to decide what religious speech is appropriate. The policy requires the school to engage in textbook viewpoint discrimination, rendering the policy unconstitutional.
The ACLJ sent a demand letter to the school district, demanding that it respect our client’s religious liberty. The school district’s actions amount to unlawful suppression of religious speech, and concerns over parental complaints are not sufficient grounds to override constitutional protections.
We will ensure the school district is held accountable for religious viewpoint discrimination. It has until May 22 to respond to our demand, or we will proceed with legal action.
We will never stop fighting to defend religious liberty in America. You might assume this school district is in a blue state like California. However, this unconstitutional attack occurred in rural Texas, which means it can happen anywhere.
Today’s Sekulow broadcast included a full analysis of the DOJ officially charging Rep. LaMonica McIver (NJ-10) for her illegal actions during a political stunt. Also, ACLJ Senior Counsel for International and Government Affairs Jeff Ballabon reacted to a senior Hamas official praising the U.S. campuses that support their cause.
