Shocking legal news out of Wisconsin today as Hannah Dugan, a former Milwaukee County judge, will not face jail time for obstruction – just a $5,000 fine – for helping an illegal immigrant escape ICE agents at her courthouse.

As reported by Fox News:

Former Wisconsin Judge Hannah Dugan was ordered Wednesday to pay a $5,000 fine for obstructing the arrest of an illegal immigrant at a courthouse but will not serve any prison time.

“I think this is a situation where an otherwise good person, upset by immigration policies in this country, made a bad decision in the moment,” said U.S. District Judge Lynn Adelman.

Dugan, 66, was convicted of felony obstruction last year after federal agents attempted to serve a warrant to Eduardo Flores-Ruiz on April 18, 2025. She was acquitted of concealing an individual to prevent arrest, a misdemeanor. She faced up to five years in prison.

Prosecutors had asked that Dugan be sentenced to between 15 and 21 months.

Dugan addressed the case against her on Wednesday just before Adelman imposed her sentence, defending her actions and announcing she intends to “return to public service.”

“My acts that day were consistent with community concerns at the courthouse,” Dugan said. “My judicial acts were not done with any malicious intent or to advance any personal interests.

“Since the government’s arrest of me, I was forced to retire. … In January, I resigned from my office so the constituents would have a judge in my branch to begin the year,” she added. “I have been cast as a scofflaw and as a hero. I am neither. I am a public servant who was just trying to do my job. Your honor, I will not let those minutes on April 18, 2025, define my life’s work.”

In January, Dugan resigned from the Milwaukee County circuit judgeship amid threats of impeachment from Republican state lawmakers, who labeled her an activist judge.

Dugan was found guilty, but the sentence was barely a slap on the wrist. In fact, it was more likely a small price to pay to become another folk hero of the radical Left.

Dugan orchestrated an elaborate plot when there was an illegal immigrant standing before her court, charged with domestic assault, and ICE showed up to serve an immigration warrant. Rather than cooperate with federal agents, Dugan distracted the officers, telling them to go talk to the chief judge, and then went back into her courtroom to announce that all proceedings were done for the day. Dugan then led the subject of the DHS warrant – and the pending domestic violence charges – through her chambers and out the back of the court to intentionally avoid the ICE agents.

However, the illegal immigrant was captured on foot anyway. And remember, this individual was there on an allegation of domestic abuse. But the judge was apparently so swept up in the Left’s “resist” mantra, she decided to take matters into her own hands like a robed vigilante, and sneaked this person out the back door.

And despite her misguided attempt to obstruct a federal operation, ICE and DHS prevailed. And now she is facing the consequences. She was suspended by the Wisconsin Supreme Court. She then chose to resign from her judgeship rather than being impeached and was then convicted in federal court on an obstruction charge brought by the DOJ. According to the guidelines from the federal government and DOJ, this type of violation carries a sentence of incarceration of anywhere from 15 to 21 months.

Yet many people feel the federal judge did Dugan a sort of professional courtesy, delivering a $5,000 fine and no jail time. It feels like she got off easy.

That said, a felony conviction of a judge means this person can no longer serve on the bench.

Today’s Sekulow broadcast included more discussion of the surprisingly light sentencing of the activist Milwaukee judge. We were also joined by ACLJ Senior Counsel for Global Affairs Mike Pompeo to discuss the demise of the deal with Iran, the recent NATO summit, and the threat against Air Force One.
