Judge Faces Felony Charges and ACLJ Files Brief at U.S. Supreme Court

Milwaukee County Circuit Judge Hannah Dugan, who hid a violent illegal immigrant in her courtroom and helped him escape the authorities, has been charged with two federal criminal counts. The specific charges include “obstructing or impeding a proceeding before a department or agency of the United States” and “concealing an individual to prevent his discovery and arrest.” The judge could be subject to prison time or excessive fines for her foolish actions that resulted in a short-lived escape attempt.

So here’s what led to the judge being arrested. An illegal immigrant, Eduardo Flores-Ruiz, was scheduled to appear in Judge Dugan’s court after being charged with three misdemeanors for domestic battery. He had punched his roommate 30 times and then hit the roommate’s girlfriend in the face. A third individual was also injured in the fracas. So Flores-Ruiz is a very violent person.

At the same time, a warrant was out for his arrest, and ICE planned to take him down outside the courthouse. (Flores-Ruiz had already been removed from the U.S. in 2013.)

Dugan became aware of ICE’s plans and confronted the ICE officials, saying they needed a judicial warrant. Then she orchestrated for Flores-Ruiz and his attorney to escape out a back door. After a short pursuit on foot, the federal authorities captured the illegal immigrant. Additionally, the truth emerged about the judge’s alleged aiding and abetting of Flores-Ruiz’s escape.

And that’s why Judge Dugan faces two federal counts after she outrageously risked her career to help a violent criminal escape. It’s a wild story that illustrates the far Left’s judicial opposition to the Trump Administration’s efforts to secure the southern border and mass deport violent criminals.

As we’ve pointed out, rogue judges across the country have been issuing nationwide injunctions against President Trump’s Executive orders. The problem is that district judges are supposed to be limited to the jurisdiction of their particular court and not issue injunctions that affect the whole country.

The ACLJ has already filed seven briefs in five federal courts to fight back. And now, on behalf of the state of West Virginia, we have filed an amicus brief regarding nationwide injunctions at the U.S. Supreme Court. My dad, ACLJ Chief Counsel Jay Sekulow, explained the far-reaching ramifications of this case:

So here’s what’s going on: There’s an emergency stay at the Supreme Court of the United States. We worked on this brief through the weekend and are ready to file it momentarily. Hopefully, it will, in fact, be the seminal and key brief on limiting the jurisdictions of these U.S. district courts that are instead of issuing their injunction covering, say, the Northern District of New York, they issue an injunction covering the entire country even though they only sit in the jurisdiction for Northern New York. It has to stop.

When we talk about law and order, when we talk about the separation of powers – what’s the President’s authority? What’s the judiciary’s? The one thing the judiciary cannot be is a policymaker, but a lot of these judges have taken that element, and the answer to that at the Supreme Court needs to be: You can’t do that.

We can’t allow rogue judges to continue to take the law into their own hands to promote their far-Left agenda. For example, what if a radical district judge decides to ban Bible studies in retirement homes nationwide? If the Supreme Court doesn’t rule in our favor, the door could be open for judges to make sweeping rulings in any case, including ours.
