Complete ‘Chaos’ Erupts Amid Rogue Judge Order

Complete chaos has erupted in court over funding for Planned Parenthood.

A rogue judge in Massachusetts has issued a partial injunction that allows the abortion giant to still receive some taxpayer funding. As a result, the judge’s injunction overrides Congress and the Constitution. It’s judicial fiat.

Honestly, this order is extremely convoluted and relates to President Trump’s “Big Beautiful Bill,” which delivered a massive blow to the abortion giant – stripping $500 million in Medicaid reimbursements. However, a judge first issued, withdrew, and reissued a temporary restraining order (TRO) in a legal shell game to continue giving Planned Parenthood $2 million a day in taxpayer funding.

Yesterday was the judge’s self-imposed deadline to issue a ruling after Friday’s preliminary injunction hearing. Either Planned Parenthood would be defunded, or the judge would have to issue an injunction.

It’s exhausting trying to understand all the legal gymnastics the judge performed to issue an injunction. Further, it’s a partial injunction, which allows approximately 25% of Planned Parenthood’s affiliates to still receive Medicaid funding.

At the same time, the judge didn’t issue a preliminary injunction for the remaining 75% abortion clinics. For those Planned Parenthood clinics, the judge said the issue “remains under advisement,” essentially kicking the can down the road. But these abortion clinics will be defunded as of right now.

The ACLJ filed an amicus brief in this case, so we know it very well. ACLJ Senior Counsel CeCe Heil explained how the judge’s opinion exposed her pro-abortion bias:

When you read the factual statement basis of [the judge’s] order, it just goes into how wonderful and how necessary and lifesaving Planned Parenthood is – and that by picking and choosing, the government is putting millions of people’s lives at risk. That’s always the favorite angle of everyone: If you cut money somewhere, by default, someone’s life is at risk. . . . As I was reading the opinion, it definitely reads like an advertisement for Planned Parenthood, so you know exactly as you read this, where this judge’s alliance and allegiance lies. However, [the judge] gets very creative because in our amicus brief that we filed in this case, we absolutely argue the fact that there’s no constitutional right for subsidies, that Congress has the power of the purse, all of those arguments, which are constitutional arguments, that the federal government, when they’re giving money, they can have strings to that.

Such rogue judges are getting as creative as possible to keep funding Planned Parenthood. These legal gymnastics come despite the U.S. Supreme Court ruling that states no longer have to send taxpayer dollars to the abortion giant and the “Big Beautiful Bill” cutting Medicaid funding.

So what are the next steps after the judge granted this partial injunction? The ACLJ will see if an appeal is filed. If either the government or Planned Parenthood (or both) files an appeal, we’ll file a brief supporting defunding.

Planned Parenthood has a tough case to prove that it’s entitled to taxpayer dollars. No business or nonprofit should be able to argue that the government must fund it.

Combine that truth with Planned Parenthood’s sordid eugenics origins, and it is outrageous that such a depraved organization should receive taxpayer dollars. The facade is cracking – and Planned Parenthood knows it.
