In its faulty decision, a California court of appeals brazenly ruled that parents do not possess the constitutional right to home school their children and that most forms of home education are illegal under state law. It stands as one of the most audacious rulings on parental rights to date. According to the court, any parent who home schools his or her child without a valid state teaching credential for the grade being taught violates state laws. Such an over-reaching and unconstitutional attempt to curb parental rights must not be permitted to stand. A decision like this could affect parents across the country. We, as members of the American Center for Law and Justice, stand with Chief Counsel Jay Sekulow in asking the California Court of Appeals for the Second District to protect and uphold parental rights guaranteed by the Constitution of the United States and upheld time and time again by the Supreme Court of the United States.

Quite simply, any attempt by a court or legislature to circumscribe the ability of parents to home school their own children is blatantly unconstitutional. Any and all such attempts must be thwarted before they further chisel away at such fundamental rights.

We support the rights of all home schooling parents in the state of California and beyond. We believe that the action taken by the California state court, in declaring home schooling illegal, is in direct violation of our constitutional freedom and cannot be permitted to stand.
