Democrats RUSHING to Supreme Court

Democrat lawmakers in Virginia are scrambling to rush an appeal to the U.S. Supreme Court to overturn the recent Virginia Supreme Court ruling striking down the far Left’s unconstitutional attempt to alter Virginia’s congressional districts heavily in their favor.

After the Virginia Supreme Court on Friday struck down a voter-approved Democratic congressional redistricting plan, Democratic lawmakers in the commonwealth notified the court they intend to appeal the ruling to the U.S. Supreme Court.

Friday’s ruling by the state supreme court delivered another major setback to the party’s nationwide battle against Republicans for an edge in this year’s midterm elections.

Democrats, led by House Speaker Don Scott and Attorney General Jay Jones, filed a motion late Friday afternoon asking the state supreme court to pause its ruling from taking effect while they appeal for an emergency hearing before the U.S. Supreme Court.

The Virginia Supreme Court ruled 4-3 that the state’s Democratic-led legislature violated procedural requirements when it placed the constitutional amendment on the ballot to authorize mid-decade redistricting. Voters narrowly approved the amendment April 21, but the court’s ruling renders the vote’s result meaningless.

Writing for the majority, Justice D. Arthur Kelsey wrote that the legislature submitted the proposed constitutional amendment to voters “in an unprecedented manner.”

“This violation irreparably undermines the integrity of the resulting referendum vote and renders it null and void,” he wrote.

Democrats had hoped to win as many as four additional U.S. House seats under Virginia’s redrawn map as part of an attempt to offset Republican redistricting done elsewhere at the urging of President Donald Trump. . . .

“Huge win for the Republican Party, and America, in Virginia,” Trump said about the decision on his social media account.

As we told you, the Virginia Supreme Court issued a ruling saying that the referendum to change the state’s congressional map violated the state’s constitution. Among the issues – the way the question was presented, and the mechanisms used, violated state law – and therefore, the redistricting vote was illegal. 

The far Left was obviously not thrilled about this, including the newly elected Attorney General Jay Jones and Virginia House Speaker Don Scott, and they wasted no time issuing a joint motion to the state’s Supreme Court, urging it to delay issuing its mandate stopping the referendum from going forward because they want to appeal to the U.S. Supreme Court.

This effort to get this to the U.S. Supreme Court is a Hail Mary. And the motion that they filed to the Commonwealth’s Supreme Court was thrown together so quickly that it had typos throughout the filing, including having Virginia and Senator misspelled.

All that aside, it’s going to be a tall order to get the ruling overturned because it mostly relies on state constitutional law. Traditionally, the Supreme Court doesn’t like to weigh in on state matters. It’s a can of worms most Justices don’t want to touch. The Supreme Court has already weighed in on redistricting, essentially sending the issue back to the involved states, essentially saying, Take it up with your state Supreme Court if you want to challenge it.

Taking all of this into consideration, it’s easy to see why the U.S. Supreme Court would not take this case, and I don’t think the Justices are looking to rehash that. This is the Left’s last resort, but the odds aren’t in their favor.
