Radio Recap: Five Lawsuits Filed Against National Emergency Declaration

Sixteen States in one lawsuit, four more lawsuits filed; we have five lawsuits now against the President’s declaration of a National Emergency.

Today on the radio program, we discussed the lawsuits that have been filed against the National Emergency declaration.

In most of the lawsuits, the issue of constitutionality is not even the focus. Numerous environmental organizations attempt argue that the construction of a border wall will cause immense environmental harm. Essentially, they argue that environmental security is more important than national security. They essentially argue that the wall would harm birds – yes birds.

As ACLJ Executive Director Jordan Sekulow explained on the program today:

The fact that in every one of these lawsuits the environment is having to be utilized to try and get standing . . . the main goal is trying to give one of these liberal judges an opportunity to find a way to let this proceed so that they can issue an injunction.

Funding for portions of a border wall have been previously approved under other Presidents and the issue of environmental harm has never come up showing that once again these lawsuits are strictly political.

In another lawsuit filed by sixteen States, they argue that their funding from the federal government for projects will be adversely affected and will have an impact on their economy.

Additionally, we discussed how the House of Representatives is likely to vote on a resolution disapproving of the wall next week. Even if the House and Senate were to pass this resolution, the President has already said that he will veto the resolution and it will likely not have enough votes to override the veto.

We continue to assert that the President has the statutory and constitutional authority to declare a national emergency under the National Emergencies Act. We are now working to file a amicus briefs in these cases in support of the national emergency declaration.

Finally, we discussed how the political Left is moving further and further toward socialism and other radical ideologies. Representatives Tlaib and Omar have both made abhorrent remarks about Israel and the President, and the leadership in the House of Representatives has failed to take action.
