Over the last three days, we have been in a series of meetings concerning the litigation activities of the American Center for Law and Justice.  As I mentioned in a previous posting, we have just filed our brief before the en banc Sixth Circuit Court of Appeals in the Ten Commandments case.  This case represents the most significant Ten Commandments case currently being litigated.  We were successful in the U.S. Court of Appeals before the three-judge panel where the court called the ACLUs arguments tiresome.  I will not be surprised if the ACLU decides to take this case to the Supreme Court of the United States.

 

We are also litigating aggressively the conscience clause cases on behalf of the pharmacists from Walgreens who were terminated because of their refusal to fill the morning-after pill.  This cutting edge pro-life case is generating a lot of interest around the country, and the American Pharmaceutical Association has backed the legal position of our clients. 

 

Our Office of Governmental Affairs has been busy preparing for the upcoming battles, specifically on the issue of eminent domain.  The Kelo decision continues to create problems for churches and property owners around the country.   Our office is working with Senator Cornyn in order to put forward legislation that would go a long way in correcting this problem.  Yesterday on our radio broadcast I received two calls about churches that were having their property taken under the Kelo decision.  This is exactly what Justice OConnor warned against when she wrote in her opinion that private homes could be taken for apartment complexes, churches for shopping malls.
