Health Care & Immigration
Although Congress is on its summer break, our work with Members of Congress continues in a number of ways. Two of the most important Congressional efforts will occur in the next few weeks when we file amicus briefs on behalf of Members of Congress in two critically important cases.
The issues at the forefront: Supporting legal challenges to the recently passed health care law. And, backing the state of Arizona in its effort to protect and defend its borders.
First, we represent more than 35 Members of Congress in the challenge to the health care law being brought by 20 States in Florida. Much like we did in Virginia, we will demonstrate why the health care law violates the Commerce Clause of the U.S. Constitution. More details about our filing in the Virginia case posted here.
On behalf of Members of Congress and thousands of you, we are asking the court to invalidate the law, and especially the individual mandate within the bill. The Florida case, along with the case in Virginia, will ultimately determine whether or not the universal health care law stands.
Of course, we have a separate, direct challenge to the health care law representing a number of plaintiffs in federal court in Washington, D.C. That lawsuit is posted here and our motion for summary judgment here.
Next, we represent more than 80 Members in Congress who support the right of Arizona to defend its borders. A federal district court judge ruled in favor of the Justice Department, which is challenging the Arizona law, blocking implementation of key provisions of the law. While we believe the federal district court erred in its ruling, we are now working on an amicus brief to urge a federal appeals court to reverse the lower court decision.
This case is critical not only for Arizona, but also for the rest of the nation as we attempt to secure our borders and protect our citizens. If the States are not permitted to enforce immigration laws, and the Federal Government continues to fail in doing its job, our national security will continue to be put at risk. Thats why so much is at stake here.
Both of these filings will occur in the weeks ahead. These are vital issues and we'll keep you posted as developments unfold.
