Another Gag Order for Trump? "They Want to Take My Freedom"

To preserve institutional integrity, Special Counsel Jack Smith wants a gag order for Donald Trump, arguing the President is undermining the investigation regarding a January 6 indictment. Trump faces four federal charges for his alleged attempt to overturn the 2020 presidential election results against President Joe Biden.

Fox News reports:

Special counsel Jack Smith [has] requested a federal judge in Washington, D.C. to impose a narrowly tailored order restricting former President Donald Trump from making public statements that could present a serious and substantial danger of material prejudicing this case.

In a filing, Smith’s office accused Trump of engaging in a sweeping campaign of disinformation and harassment intended to intimidate prosecutors and undermine public confidence in the judicial system during his prosecution.

In service of his criminal conspiracies, through false public statements, the defendant sought to erode public faith in the administration of the election and intimidate individuals who refuted his lies, the filing said.

So in other words, Smith wants to silence Trump and not allow him the chance to defend himself publicly, violating Trump’s First Amendment right to free speech – which Trump alluded to in responding to the gag order: “[T]hey want to take away my freedom.”

And the former President is right. Why shouldn’t the leading GOP nominee be allowed to criticize the Deep State pile-on that’s happening to him? He’s a public figure being denied the right to defend himself in the court of public opinion.

Add this gag order request to the 14th Amendment fiasco, as the far Left is unconstitutionally trying to deny Trump the right to be on primary ballots, and the pile-on is undeniable. The notion that an American citizen can be removed from a ballot without legal adjudication just because political opposition doesn’t like them is shameful.

We were in court today in Colorado fighting for all Americans to have the right to vote for the candidate of their choice. During our radio broadcast, we got the news that a judge granted us intervention status in our case, which is a big win for the ACLJ. We are now on an expedited schedule and could have a trial date soon.

We’ve got a vital petition fighting the far Left’s “disqualification plot” against Donald Trump. We want to get 100,000 signatures so we can share your voice. Sign this petition and share it with your friends. When we file our next brief, we want to say we have 100,000 ACLJ Members standing with us to defend election integrity from the radical Left’s attempts to subvert the Constitution.

ACLJ Special Counsel for Government Affairs Craig Parshall joined to give an update about a victory against Facebook’s censoring of pro-life advocates:

A U.S. citizen was simply posting a message about the illogic and moral bankruptcy of the pro-abortion position that says we’re compassionate about the mother and the child because the child is going to be unwanted. Well, in the words of this pro-life poster, let’s just kill it [the unwanted child]. And really, that’s what they’re saying. That’s the illogic and the moral bankruptcy of their position. Well, the machine-learning computer systems in Meta and Facebook caught the word kill, and they immediately said this is a suspect and likely to be censored post. They then pitched it to a human moderator who looked at the content, and they made the same mistake. They said, oh, you can’t use the word kill even metaphorically, even rhetorically about the pro-life movement. So they took [the pro-life post] down.

The ACLJ filed a brief urging that the post be restored based on a correct understanding of the context of the word kill. This pro-life post was not actually saying to kill someone. Facebook’s Oversight Board agreed with us and restored the post, thereby respecting the pro-life advocate’s free speech.

This is a significant victory for free speech. We will never stop fighting for the First Amendment rights of those speaking out to save the unborn.

Today’s Sekulow broadcast fully analyzed Trump’s gag order and our Colorado case. Finally, we are so grateful for the generous response of ACLJ Members to our Matching Moment last week to raise funds to support this important new case.

We are currently working in other states to discuss possible legal options to combat the radical Left’s twisting of the 14th Amendment. We expect to announce the next state we are officially representing very soon. Be sure to follow us on social media to hear our latest updates in real time.

Thank you again for continually supporting the ACLJ in our mission to preserve life and liberty.
