Election Law

Yesterday we announced our new case to defend the constitutional voting rights of all Americans. We are representing the Colorado Republican Committee in their fight to preserve voting rights for citizens in Colorado. There is ongoing litigation now in 13 states as the threat to your right to vote for the candidate of your choice continues. Only one case has been dismissed thus far (in Florida).

The Left is attempting to use the novel theory that the 14th Amendment “disqualifies” President Trump from running in the 2024 presidential election.

CBS News reports:

Amid the legal troubles former President Donald Trump is facing in federal and state courts, efforts to keep him off the primary and general election ballots under a little-known provision of the Constitution are gaining traction in several states.

The legal actions invoke what is known as the disqualification clause, Section 3 of the 14th Amendment, and the provision has now been cited in . . . lawsuits brought by voters in Colorado and Minnesota [among other states] who argue Trump is constitutionally ineligible to hold federal office because of his actions surrounding the Jan. 6, 2021, assault on the U.S. Capitol.

The suits aimed at the former president set up what are sure to be closely watched legal battles that will test the reach and force of a constitutional provision enacted in the wake of the Civil War, and the outcomes could upend the Republican primary if Trump, currently the leading candidate for the GOP nomination, is found to be ineligible to seek the White House for a third time.

The ACLJ is already fighting against this blatant election interference – and we are willing to go to the U.S. Supreme Court if necessary. As you know, we are representing the Colorado Republican Committee right now. We are also working with other states to discuss legal options to protect your right to vote for the candidate of your choice.

Timing is of the essence in the litigation being filed. The lawsuits will have to go through the state and federal courts – and likely the Supreme Court. But we expect this litigation to be wrapped up before Super Tuesday in March 2024.

Again, the whole point of this litigation is to keep the current leading Republican nominee off primary ballots in different states. That would mean millions of voters would be disenfranchised from voting for the candidate of their choice.

Former Secretary of State Mike Pompeo joined us in the studio to discuss the threat that the radical Left poses to our Constitution:

I don’t know that we can predict precisely what will happen next, but [the far Left is] so determined, so focused, and those of us who are conservatives – conservative believers – should remember this because this is certainly about President Trump in particular, but this is about our ideas more broadly. This is about the things we believe about America. . . . They’re now going to try and disqualify an American citizen from running for President of the United States under a crackpot theory on the 14th Amendment that is somehow “self-executing,” whatever they actually think that means. This is a determined effort – the likes of which we haven’t seen and is something we’re all going to have to work our tails off to make sure doesn’t become the dominant political force in America.

If the radical Left can prevent you from voting for your candidate in the 2024 presidential election, what will stop them from doing the same in future elections? We must win this fight.

Today’s Sekulow also featured an interview with Senator Bill Hagerty (TN), who discussed the dangers of Biden’s deal with Iran. Also, our Matching Moment ends tomorrow at midnight as we raise support for our new lawsuit to protect Americans’ voting rights. All gifts that you give are doubled instantly.
