Former Deputy Attorney General Rod Rosenstein was grilled today on Capitol Hill.

On today’s Jay Sekulow Live we discussed former Deputy Attorney General Rod Rosenstein’s testimony today before the Senate Judiciary Committee. The key moment was when former Deputy Attorney General Rosenstein testified that he would not have signed the FISA warrant if he knew then what he knows now.

Senator Lindsey Graham asked Mr. Rosenstein if he’d looked at Inspector General Horowitz’s report. When Mr. Rosenstein replied in the affirmative, Senator Graham then asked:

If you knew then what you know now, would you have signed the warrant application?

Mr. Rosenstein replied:

No I would not.

I think it was a remarkable hearing today with former Deputy Attorney General Rod Rosenstein. Remember, for the purposes of appointing Bob Mueller and the Russia investigation, he was the Acting Attorney General. The buck stopped with him when it came to the Department of Justice’s decisions and the decisions of the FBI.

He is playing a game on Capitol Hill, basically admitting that he didn’t read everything. If you actually listen closely, what he is saying is he didn’t really pay attention. Sure, it was a high profile case, but they had other cases. Of course they did, but none of the others involved accusing the President of the United States of being a Russian asset.

My dad, Jay Sekulow, made the following point:

If he knew what he knows now, the information he has now, he would have never signed the FISA warrant. You know what that tells me? Nobody was paying attention, including Rod Rosenstein, to what was going on. That’s number one.

Number two, when he reviewed the FISA he hesitated. He said, well, I don’t know if I’d say I read every word of it, or word for word. You are issuing a FISA on an individual who is associated with the campaign of the President of the United States and you didn’t have time to read the file? You didn’t have time to review the entire FISA warrant? But the information he has now, if he would have had it then he would have never done it. The question is why did they not have it then? Because they were too busy chasing a bogus fraud on the American people called the Mueller Report and it was self-justification.

That’s all this was at the end of the day.

He’s now admitted under oath, testified under oath, that he was specially briefed on this specific FISA. We know that these FISAs failed in the past. Now we know that. So he knew this was coming.
