When Corporations Silence Women’s Choices: Why Abortion Pill Reversal Information Matters

The ACLJ is representing Stanton Healthcare, a faith-based medical provider serving women and families in Idaho, after a national billboard company refused to display Stanton’s advertising about abortion pill reversal (APR). The company justified its refusal by claiming APR “has not been deemed safe and effective by the FDA” – a statement that reflects a widespread but misleading narrative that threatens to deprive women of lawful medical information at a critical moment. 

Stanton Healthcare is a licensed medical provider offering professional, compassionate care to women facing unexpected or difficult pregnancies. Its services include pregnancy testing, ultrasounds, medical consultations, and information about available medical options – including abortion pill reversal for women who change their minds after beginning a chemical abortion.

Stanton sought to place billboard advertisements to ensure women know that help is available and that time-sensitive medical options exist.

Despite initially approving the campaign, the billboard company later reversed course and refused to display the ads.

The Truth About FDA Approval and Medical Practice

The refusal was premised on the claim that abortion pill reversal has not been deemed “safe and effective” by the FDA. That assertion misunderstands both FDA authority and the practice of medicine.

The FDA approves drugs for specific labeled uses. Once approved, physicians may lawfully prescribe medications for other medically appropriate purposes – a practice known as off-label use. This is common throughout medicine.

Progesterone – the medication used in APR – is FDA-approved and has been safely used for decades to support pregnancy, prevent miscarriage, and treat hormonal deficiencies.

Importantly:

  • The FDA does not regulate the practice of medicine.
  • The absence of FDA approval for a particular use does not mean the use is unsafe.
  • Lawful medical services do not require an FDA “safe and effective” designation to be advertised.

Drug-induced abortion involves two drugs. The first, mifepristone, blocks progesterone – the hormone necessary to sustain pregnancy. The second drug induces contractions to complete the abortion.

APR works by administering progesterone after mifepristone ingestion to counteract its effects and support the pregnancy.

Progesterone is:

  • Naturally occurring
  • Widely used in reproductive medicine
  • Prescribed to prevent miscarriage and preterm birth
  • Recognized as safe across decades of clinical use

Many women begin a chemical abortion under pressure, fear, or uncertainty, and then later regret their decision. APR offers a narrow window in which they may choose to continue their pregnancy, and over 8,000 babies have been saved by APR.

Denying access to this information does not protect women. It removes options when time matters most.

Across the country, APR has become a target of political and ideological campaigns. Some states have attempted to restrict providers from offering or even discussing APR while allowing other off-label uses of progesterone to continue – raising serious constitutional concerns. Additionally, when corporations adopt viewpoint-based restrictions disguised as compliance policies, women lose access to vital healthcare information.

This case is about more than a billboard. It is about whether women will be allowed to receive accurate, time-sensitive medical information when facing one of the most difficult decisions of their lives. Stanton Healthcare sought only to inform women that help exists and that a second chance may still be possible.

The ACLJ is committed to defending the rights of medical providers to share lawful medical information and to ensuring that women are not denied life-affirming options because of misinformation, ideological pressure, or unlawful censorship.

When a woman changes her mind after beginning a chemical abortion, she deserves to know all of her options.

Anything less is not choice – it is control.

And the ACLJ stands firmly with Stanton Healthcare to stop this viewpoint discrimination.

At its core, this case is about whether women will be given full and truthful information at a critical moment in their lives. No corporation should be allowed to silence lawful medical speech simply because it is controversial. Women deserve access to accurate, time-sensitive options – not censorship driven by ideology. The ACLJ will continue to defend Stanton Healthcare’s right to speak and to ensure that women are not denied information that could change their future.
