ACLJ Preparing To File Amicus Brief on Behalf of Wyoming Legislators To Defend Abortion Ban at WY Supreme Court

We’re preparing to take legal action in yet another state Supreme Court as part of our 50-state campaign to defend pro-life laws from a litany of lawsuits from the abortion industry.

In July of this year, abortionists filed a lawsuit in an attempt to strike down Wyoming’s newly enacted abortion ban. They also filed a motion asking for a temporary restraining order to prevent the ban from being enforced while the lawsuit progressed. A Wyoming state judge granted that restraining order, prohibiting the state from enforcing the abortion ban. In response, attorneys for Wyoming filed a motion requesting that the judge send the case to the Wyoming Supreme Court. On November 21, the judge heard oral argument concerning the motion, and, on November 30, decided to send a list of questions to the state Supreme Court.

Now, the Wyoming Supreme Court has been requested to answer 12 questions, including “whether House Bill 92 is unconstitutionally vague, whether it violates Wyomingites’ right to privacy as well as to other sections of the state Constitution, including an individual’s rights to equality, to make health care decisions and to private property.”

The Wyoming Supreme Court has until January 9, 2023 to decide whether it will hear the case.

Meanwhile, the ACLJ is preparing its amicus brief in support of the state and on behalf of the pro-life legislators who passed the abortion ban. We have been working closely with the Wyoming Senator who sponsored the state Senate version of the bill and have 20 other Wyoming legislators who will be adding their names to our brief. We anticipate that the Wyoming Supreme Court will decide to take the case, and we will file our brief soon after that decision.

We have recently filed in four state Supreme Courts (OK, SC, KY, and MI) in defense of pro-life laws and are taking legal action in numerous states to defend the lives of the unborn.
