The U.S. Supreme Court Denies DOJ’s Ploy To Allow Illegal Voting

The U.S. Supreme Court just announced a huge decision that will directly affect the 2024 presidential election. The ACLJ had filed an amicus brief in support of Virginia after the Biden-Harris DOJ sued the state for removing noncitizens from the voting rolls. The Supreme Court’s order today will allow Virginia to remove noncitizens from its voter rolls before Election Day. Also, President Joe Biden just took a page out of former presidential nominee Hillary Clinton’s playbook (where she called conservatives “deplorables”) in calling President Donald Trump’s supporters “garbage.” How will Biden’s comments affect Vice President Kamala Harris’ campaign?

First, let’s dive into the huge news out of the Supreme Court. Last week a federal judge ordered that 1,600 noncitizens must be restored to Virginia’s voting rolls. The state then appealed to the Fourth Circuit Court of Appeals, but the federal appeals court upheld the judge’s order. The case eventually made its way to the Supreme Court.

Yesterday, the ACLJ submitted its amicus brief to defend election integrity to the Supreme Court. In it, we argued that Virginia was individually assessing voters for removal only after those individuals provided official information proving they were not citizens. This is not illegal under federal law, nor could it be. Thus, Virginia was merely fulfilling its constitutional responsibility and authority to protect and enforce election qualifications.

We are pleased to announce that the Justices (agreeing with the arguments of our brief) granted a stay to keep noncitizens from openly interfering in the election. In its 6-3 ruling, the majority ruled exactly as we had requested in our brief.

The order stated in part: “The application for stay presented to The Chief Justice and by him referred to the Court is granted.” In other words, the lower courts’ rulings are frozen until a merits decision can be reached. Since the election is days away, Biden’s DOJ will unlikely be capable of obtaining any kind of final ruling in time to complete its election interference efforts in Virginia.

Governor Glenn Youngkin – who found himself right in the middle of the controversy after removing the noncitizens from Virginia’s voting rolls – responded to the Justices’ decision:

We are pleased by the Supreme Court’s order today. This is a victory for commonsense and election fairness. I am grateful for the work of Attorney General Jason Miyares on this critical fight to protect the fundamental rights of U.S. citizens. Clean voter rolls are one important part of a comprehensive approach we are taking to ensure the fairness of our elections. Virginians also know that we have paper ballots, counting machines not connected to the internet, a strong chain of custody process, signature verification, monitored and secured drop boxes, and a ‘triple check’ vote counting process to tabulate results. Virginians can cast their ballots on Election Day knowing that Virginia’s elections are fair, secure, and free from politically-motivated interference.

Today’s ruling could also impact other states, where the far Left is trying to keep noncitizens on voting rolls. In fact, the ACLJ is planning on filing another amicus brief at the Supreme Court tomorrow in a case out of Pennsylvania where the state is trying to count illegal votes. The fight for election integrity is far from over.

I next want to focus on Biden’s disgusting comments about conservatives. (“The only garbage I see floating out there are [Trump’s] supporters.”) Did the far Left not learn from the mistake that Hillary Clinton made during her campaign? It’s never a good idea to demonize half of America.

And now the far Left is scrambling to explain away Biden’s comments. In what’s become known as “apostrophe-gate,” White House staffers released the transcript of Biden’s comments. The transcript reads: “The only garbage I see floating out there is his supporter’s.” Do you see how they added an apostrophe to “supporters” to make it sound like Biden was referring to one supporter? It’s ridiculous.

The far Left is getting desperate. Calling Trump Hitler and his supporters “garbage” is its only strategy now. The Harris campaign is trying to distance itself from Biden’s comments, but the damage could already be done.

The election is days away. Visit our election integrity action page to sign our petition and get involved. Also, download our limited-time ACLJ Election Prayer Guide and pray for America during this time.

Today’s Sekulow broadcast included a full analysis of the U.S. Supreme Court’s monumental decision to preserve election integrity. Five for Fighting’s John Ondrasik discussed his op-ed on behalf of American hostages in Gaza, and Kari Lake called in to discuss the border crisis.
