New York Judge Opens Door To Dismiss Trump Case

President-elect Donald Trump’s Manhattan legal woes might be coming to a close. Judge Juan Merchan just granted Trump’s request to be able to file a motion to dismiss DA Alvin Bragg’s case against the President. Trump’s attorneys sent the judge a letter on Wednesday asking that the sentencing be dismissed based on the outcome of the election and the U.S. Supreme Court’s ruling that Presidents are immune from prosecution for “official acts” while in office.

My dad, ACLJ Chief Counsel Jay Sekulow, gave his thoughts on the judge’s decision:

The big issue in this motion to dismiss is this: Was evidence submitted at trial that the jury heard, based on the Supreme Court’s decision in the immunity case . . . could that evidence have been tainting the jury? Conversations, for instance, that were admitted to trial between the former President (now President-elect) and his staff? And the jury heard all that. I don’t think there’s any way, Jordan, that can be separated.

I think Judge Merchan had no choice in this situation. He needed to do three things. 1) He had to postpone the sentencing. Here’s why: We argued at the Supreme Court of the United States for President Trump . . . that these kinds of interruptions to the presidency should not be allowed. Merchan knows that now. That is now the law based on the case we did. 2) The evidence did taint the jury, of course. 3) You can’t do anything that interferes with a sitting President. . . . The Supreme Court said a state process cannot interfere with the President.

Judge Merchan’s decision is a huge victory for President Trump. And it’s a sign that the courts are finally using reason and logic when it comes to the relentless prosecution against President Trump.

We also have the big news that President Trump revealed his choice, former Florida Attorney General Pam Bondi, for U.S. Attorney General after U.S. Rep. Matt Gatez (FL-4) withdrew his name from consideration. I am very familiar with her because she was our colleague in defending President Trump during his impeachment trial.

President Trump knows that his AG needs to be more than ready to run the DOJ on Day 1 because of all the chaos from the now-debunked Russian collusion narrative (“Crossfire Hurricane”). All this outrage led Special Counsel Robert Mueller to investigate President Trump – and it led to Trump’s eventual impeachment by the House of Representatives.

The new AG will also be key in fixing the Deep State FBI. We’ve told you repeatedly about all the FBI targeting of Christians, conservatives, and political opponents. The ACLJ has been embroiled in FOIA requests and lawsuits for the last several years because of the corrupt FBI, and Bondi should help end the weaponization of the FBI.

ACLJ Senior Advisor for National Security and Foreign Policy Ric Grenell reacted to the Bondi nomination:

Pam is a friend of mine, and she is an amazing person, but she’s also a great lawyer. And so this was a fantastic pick. As everyone knows, Pam did a phenomenal job in Florida. She’s been on the outside, helping President Trump where she could. She is going to bring a level of clarity to the DOJ. She’s a warrior. She is not ever someone who is bothered by criticism. And that’s one of my criteria for having all these positions: You have to do the right thing. You can’t be concerned about what the Washington media or the Washington critics are going to say. You have to be able to face them and do the right thing.

Grenell also praised Bondi’s fearlessness, saying she will be more than willing to go after the D.C. swamp. She won’t allow the Deep State DOJ to undermine President Trump’s agenda. She will also ensure the American people’s liberties are protected.
