DANGER IN TEXAS: Court Chaos Denies Illegal Arrests

We’ve got chaos in the courts as Texas remains divided over illegal immigration, while hordes of undocumented migrants continue to cross into the United States.

Within hours of the Supreme Court of the United States ruling that the State of Texas could enforce its own immigration laws, allowing Texas law enforcement to arrest illegal immigrants, the U.S. Court of Appeals for the Fifth Circuit put the ruling back on hold as they prepare to hear more arguments today.

As reported, the Texas law known as Senate Bill 4 (SB4) “makes crossing into the Lone Star State through the U.S.-Mexico border without legal documentation a misdemeanor punishable by up to six months in jail. Anyone accused of entering the country illegally after being previously denied admission or deported could be charged with a felony punishable by up to 10 to 20 years in prison.”

Texas has a right and responsibility to defend its citizens first, as does every state in the union. Recently we’ve all seen how illegal immigration has created a very real and very deadly threat to Americans. States should be able to arrest and if warranted deport illegal migrants who enter – and it’s not hyperbole to say invade – the United States.

The Texas law – SB 4 – could fall under a constitutional provision that would allow the states to enforce the law if what’s happening qualifies as an invasion. And as my dad, ACLJ Chief Counsel Jay Sekulow, added: “That’s because there is a provision in the Constitution that says if a state is being invaded, which this constitutes an invasion, if the state is being invaded then they can take action to protect their citizens.”

It’s not hyperbole to say that what Texas and the border states are dealing with absolutely qualifies as an invasion. The southern border and our Border Patrol agents have been overrun with hundreds of thousands of undocumented crossings, far more than they can handle, and innocent Americans have died at the hands of coldblooded killers who’ve illegally snuck into our country as a result, not to mention the scores of deaths at the hands of fentanyl that has been pouring across the border.

We also updated everyone on the current situation in the Georgia election interference case against President Donald Trump and the controversy surrounding Georgia DA Fani Willis. The judge presiding over that case, Fulton County Superior Court Judge Scott McAfee, has ruled that he will allow President Trump to immediately appeal the order that denied the disqualification of Fani Willis, despite the clear appearance of impropriety. As we told you yesterday, even the judge admitted there was an “odor of mendacity” about the case, meaning even he suspects the DA isn’t telling the truth.

It’s worth noting that Judge McAfee did not have to allow the appeal so this is a decided victory for President Trump and his defense team. The ACLJ will be filing an urgent amicus brief in the case urging the Georgia Court of Appeals to take on the case, and we’ll be prepared to file again if and when that happens.
