Major Update in Fani Willis Appeal

Today, the ACLJ legal team filed a major brief in DA Fani Willis’ case against former President Donald Trump to disqualify DA Willis and protect the integrity of our judicial system. Judge Scott McAfee refused to remove Fani Willis, who campaigned on prosecuting Trump, even after ruling that an “odor of mendacity” – lying – hung over the case.
While Judge McAfee allowed Willis to stay on the case if Special Prosecutor Nathan Wade was removed, his language was condemning. Many things he touched on suggested a conflict of interest, or at the least an appearance of a conflict. So how can we expect impartiality in this case?
As we stated in our amicus brief:
The existence of a conflict of interest, including an apparent conflict, is an issue of such structural magnitude that it affects the entirety of a criminal proceeding. A conflicted prosecutor who nonetheless proceeds with prosecution casts an “odor of mendacity” over an entire proceeding that cannot be corrected or remedied after the fact. Beyond its unconstitutionally injurious impact on the Defendants, the odor negatively impacts the public’s perception of and confidence in the judicial system—especially when the prosecution is that of a leading national candidate for the highest office in the land.
Our filing was critical because the implications of the case are much broader than President Trump. The brief explains:
Millions of Americans from the other forty-nine states who have no ability to influence Georgia’s local political conduct are watching this case and will be directly affected by its outcome. The bad choices, prejudices, and personal political motivations of Fulton County’s District Attorney, and the Georgia judiciary’s response thereto, impact the entire nation. The integrity of Georgia’s criminal justice system—implicating its prosecutors and its courts—is at stake.
We want to preserve the integrity of the judicial system. The American people should not trust this prosecution and should see it as the far Left interfering with the election. The Georgia Court of Appeals should disqualify DA Willis.
While prosecutions against former President Trump drag on, President Biden’s floundering reelection campaign has drawn growing attention, sparked by the first presidential debate a few weeks ago.
Last night, in his first solo press conference since November 2023, President Biden reaffirmed his reelection bid despite a growing number of Democrats, including major donors, urging him to drop out of the race. NBC reported a sentiment held by many on Biden’s reelection campaign: “No one involved in the effort thinks he has a path.”
Americans are focused on Biden’s ability to answer questions. But what about our adversaries? Over the last three years, he has not been able to deliver security around the world. So this is nothing new and is just reinforcing what we already know. The bar is set extremely low for President Biden. He even received praise just for getting through the conference. Yet, he didn’t give any major insight into foreign policy. And he still made some major gaffes – like referring to Vice President Kamala Harris as Vice President Trump.
Former Acting Director of National Intelligence Ric Grenell offered insight on this developing situation:
I’m shocked at how many reporters and newsrooms I’m seeing that are literally just calling for an undermining of democracy. They’re just outright wanting Joe Biden replaced. They’re not even talking about the election that every state had to pick Joe Biden. I’ve never seen reporters so gleeful in undermining democracy. They don’t even mention it. They don’t even say anything about the process other than it’s clear Joe Biden is going to lose, so we should replace him. I find it incredibly troubling.
I think for three years, all the senior staff and cabinet have been holding their breath whenever Joe Biden goes to a microphone. They’ve known this . . . and there needs to be a full investigation, and that investigation needs to reveal who knew that the President of the United States was sick and didn’t tell us.
