DOJ Fights Against Trump Special Master
The Department of Justice (DOJ) just filed an appeal of the federal judge’s ruling that ordered the appointment of a Special Master to review the documents that were seized by the FBI in its unprecedented raid of President Trump’s home.
The DOJ actually submitted two filings. The first one asked for a partial stay of the judge’s order and warned if they weren’t granted the stay they would just file an appeal. But then the DOJ just went ahead and filed the appeal, asking for the entire order to be overturned.
So despite having admitted twice that it mishandled the documents, Biden’s DOJ doesn’t want an independent Special Master to see what the FBI agents actually took, so it’s essentially telling the judge: either grant us a stay, or we’ll just seek relief from the 11th Circuit. Meanwhile they’ve actually already filed the appeal. The Deep State DOJ is just desperately firing all guns and hoping one finds its target. I wonder why.
Maybe because they know handing the documents over to the Special Master takes away their control. It threatens to expose the well-crafted narrative they’ve been spinning thus far. And they don’t want that.
My dad, ACLJ Chief Counsel Jay Sekulow, called out the absurdity of the DOJ’s appeal given how its handled the raid and the seized classified documents:
Here’s what’s so fascinating to me about this. They specify that they’re only seeking this kind of special stay for one-hundred documents that they view to be classified. Now these documents they know have been gone for a period of time, almost a year and a half. So here’s an interesting dilemma, or an interesting comment, what is in those hundred documents that they’re so concerned about that they waited a year and a half to do all this? . . . We know of at least two instances where the district court said that the Department of Justice sent the information to the investigators even though it was supposed to be controlled by the taint team. So I mean, you have to put all of this in that kind of context. What is it that the government is trying to do? They’re saying if you don’t order our way really quickly, we’re going to file a notice of appeal. Oh by the way, we filed the notice of appeal . . . the same day.
As my dad also pointed out, the DOJ’s brief claims that the court’s order appointing the Special Master forces the intelligence community to pause its investigation, and that is patently false. They can absolutely continue their investigation, but they can’t snap up anything they see and shrug your shoulders and claim it could be evidence. There are rules and procedures in place to protect the rights of American citizens. What we’re really seeing played out here is the Deep State’s refusal to follow the rules when it doesn’t serve their agenda.
