DEMOCRACY UNDER ATTACK: ACLJ Set for Historic Filing at Supreme Court
The Colorado Supreme Court’s decision to ban President Trump from the ballot has resulted in an avalanche of other blue states using the Left’s radical 14th Amendment interpretation to try to remove Trump from their ballots. Our democracy is under attack. If the Left is successful, we will witness the greatest election interference in U.S. history.
The ACLJ is moving at lightning speed to file an appeal at the U.S. Supreme Court in five days to remedy this judicial emergency. We will be working through the holidays to ensure chaos doesn’t unfold in the 2024 presidential election and beyond. If we lose our right to vote, then we lose our constitutional republic.

While much of the nation focuses on Colorado, the ACLJ is celebrating a victory as a West Virginia federal court dismissed a 14th Amendment lawsuit to remove President Trump from the ballot. We represent the West Virginia GOP in our ongoing multistate legal battle to ensure all Americans have the right to vote for the candidate of their choice.
West Virginia’s Parkersburg News and Sentinel reports on this win for election integrity:
Unlike in Colorado, a case brought in federal court to keep former Republican president Donald Trump off of the primary and general election ballots in West Virginia was dismissed.
In a memorandum opinion and order released Thursday evening, U.S. District Judge Irene C. Berger granted motions made by attorneys for Trump, Secretary of State Mac Warner, and the West Virginia Republican Party to dismiss a lawsuit brought in September by Texas resident and write-in presidential candidate John Anthony Castro. . . .
“This is a big win for the integrity of our elections,” said Attorney General Patrick Morrisey in a statement Thursday evening. “This lawsuit was frivolous to begin with and without merit – it had no basis in either law or fact. Any eligible candidate has the right to be on the ballot unless legally disqualified, and we will defend the laws of West Virginia and the right of voters and candidates to the fullest.”
We are pleased that election integrity will prevail in West Virginia. We have won similar 14th Amendment lawsuits in multiple other states. Unfortunately, as we pointed out earlier, blue states – even Michigan, where we won a case while representing 15 state GOPs – are already considering going the same route as Colorado.
Former Secretary of State Mike Pompeo joined our broadcast to forecast America’s future if the Left’s attempt at election interference is successful:
This is a dangerous time because . . . we will undermine [our] central institutions in ways that will be incredibly difficult for our republic to get back. . . . There is literally no logic to a state court being able to make a decision about who can and who cannot run for President of the United States. . . . This will unleash real dangers, and we ought to try and get this back in the box as quickly as we can.
Secretary Pompeo is absolutely correct in that Pandora’s box is about to be opened. If this judicial emergency isn’t resolved, then an unmitigated disaster will be unleashed on our electoral process.
