Fox23News, Albany, NY - Judge: Student Can Wear Rosary to School, For Now

"He was jumping up and down. I don't think he thought this was gonna happen," said Chantal Hosier.
Thirteen-year-old Raymond Hosier will now be allowed to attend school on Tuesday wearing his rosary beads on the outside of his clothes.
"For right now he gets to go to school with his rosaries and he can't get suspended," said Hosier.
Raymond's mother Chantal Hosier says it is certainly a relief.
Federal Judge Lawrence Kahn issued a temporary restraining order Tuesday afternoon after the hosier's through the American Center for Law and Justice filed a lawsuit against Schenectady schools that says the actions by the district are unconstitutional.
Two weeks ago, FOX23 News was the first to bring you Raymond's story. He was suspended from school after wearing rosary beads.
"I was just mad they were suspending me for rosary beads and I told them I wasn't in a gang. They just resemble my brother and uncle," Raymond Hosier said on May 19.
However school policy forbids beads out of fear they may be gang related. The seventh grader isn't part of a gang.
He was suspended again last week when he tried to go back to school.
"I didn't chose for Raymond not to be in school, they did. And I wanted him and I took him to school every day," said Chantal Hosier.
This is a fight Raymond would not back down from. His parents were behind him all the way.
Their battle made national news and grabbed the attention of many religious groups. Hosier says there are important lessons to be learned here.
"He's learned a lot about his constitutional rights...he's learned a lot through this process...I'm proud of him. I couldn't be more proud of him," said Hosier.
This is just the first step. Both sides will attend a hearing on June 11 in federal court in Albany where the judge could make a final decision.
