Will Supreme Court Find Commandments Constitutional?
After reviewing the questioning by the Justices in these two cases, it is clear to me that there is no way the Supreme Court will conclude that displays like the one on the marble frieze in their own courtroom will be removed. I cannot imagine a decision that will bring in the sandblasters. It just won't happen. I do believe the high court will spend some time determining the line it wants to draw concerning the constitutionality of these displays. The decision on these cases is likely to be released at the end of the term - probably in June.
The issue of the constitutionality of these public displays of the Ten Commandments was certainly debated in the news media. I took part in several televised debates including on CNN's Crossfire with Barry Lynn of American United for Separation of Church and State. I also appeared on The O'Reilly Factor on Fox News where I told Bill that the ACLU is absolutely unapologetic in its zeal and desire to remove any reference of our religious faith and heritage from the public square. Our attention at the ACLJ is now focused on a very serious situation in Florida, where Terri Schiavo could be put to death soon because the Florida court system has cleared the way for removal of her feeding tube -- a death by starvation and dehydration. A stay is in place until March 18th and we are working with attorney David Gibbs in Florida who is representing Terri's parents. We are offering our legal assistance there. But the fact is - it is time to petition Florida Governor Jeb Bush and the state legislature to take action to save Terri's life. Every avenue must be explored and we are urging people across America stand with Terri and her parents and demand that the Governor and legislature do whatever is necessary to protect Terri from this death sentence.
