ACLJ Calls Supreme Court Vacancy Created by Justice O'Connor Retirement "Most Critical" for the Nation

(Washington, DC) -The American Center for Law and Justice (ACLJ), focusing on constitutional law, said today that the resignation of Justice Sandra Day O'Connor creates the "most critical vacancy possible on the Supreme Court of the United States. The announcement clears the way for what is expected to be a contentious battle over the nomination and confirmation of her replacement.
"The resignation of Justice O'Connor creates a pivotal shift on the Supreme Court," said Jay Sekulow, Chief Counsel of the ACLJ, who argues frequently before the Supreme Court. "Justice O'Connor has represented the swing vote in determining the outcome of many of the most important decisions over the past decade. There could not be a more significant opportunity for President Bush to impact the direction of the high court than with the replacement for Justice O'Connor. The ACLJ is poised to ensure that the replacement named by President Bush receives speedy consideration by the Senate."
Sekulow said he expects President Bush to nominate a replacement without delay. President Bush has been very consistent in his view of judicial nominees, said Sekulow. He believes in nominating people who understand and interpret the constitution, not legislate from the bench.
Sekulow added: That is exactly what we expect President Bush to do now put forth a nominee for the high court who will embrace the constitution, not re-write it.
Sekulow said the ACLJ is working closely with other organizations and prepared to launch a nationwide campaign in support of President Bushs nominee.
Everyone understands the importance of the courts especially the Supreme Court of the United States, said Sekulow.
