Attorney General Barr told Congress yesterday that the Department of Justice has appointed a U.S. attorney to look at whether the unmasking by the Obama Administration should lead to criminal charges.

On today’s Jay Sekulow Live, we discussed Attorney General Barr’s testimony before the House Judiciary Committee during which he revealed he has appointed a U.S. attorney to look into the Obama Administration’s unmasking of General Flynn. That means there is a separate criminal investigation looking into unmasking requests made by officials under the Obama Administration.

At the Judiciary Committee hearing, Congressman Jim Jordan asked Attorney General Barr the following question:

38 people unmasked Michael Flynn’s name 49 times in a two month timeframe. Seven people at the Treasury Department unmasked Michael Flynn’s name. Is this an issue that Mr. Durham is looking into?

Attorney General Barr responded by saying:

I’ve asked another U.S. attorney to look into the issue of unmasking because of the high number of unmaskings and some that do not readily appear to have been in the line of normal business.

Congressman Jordan then asked another question for the sake of clarity:

Wait, wait, I want to be clear, so there is another investigation on that issue specifically going on at the Justice Department right now?

Attorney General Barr responded, “Yes,” and shared that the special investigator is U.S. Attorney John Bash of Texas. According to A.G. Barr, Mr. Bash is looking into the unmasking issue, and that the time period in question goes well beyond simply the waning months of the Obama Administration.

We all knew about Attorney General Barr appointing U.S. Attorney John Durham to investigate potential wrongdoing, in the Russia matter which involves the Steele Dossier, the General Flynn matter, the FBI and DOJ attorneys doctoring emails, and more.

But while we already knew about this criminal investigation going on, A.G. Barr confirmed in yesterday’s hearing that there is a separate criminal federal investigation going on regarding the unmasking requests by Obama Administration officials, including unmasking requests made by fromer Vice-President Biden and President Obama’s Chief of Staff.

We also further discussed a big win in our pair of unmasking FOIA lawsuits where a federal court judge issued a critical opinion. As we said in our announcement of the victory:

According to the court, the State Department may no longer refuse to admit or deny the existence of records of Obama Administration senior official Samantha Power’s unmasking activity involving Lt. Gen. Michael Flynn, a list of which the National Security Agency (NSA) declassified in May.
