Late yesterday evening, we received word from the U.S. Court of Appeals for the Seventh Circuit that we won a major case involving the public display of the Ten Commandments.  Interestingly, the monument is displayed on property owned by the Fraternal Order of Eagles. The national headquarters of the Fraternal Order of Eagles in Wisconsin has a light on the top of its building that shines onto this famous Ten Commandments monument.  The monument was originally donated to the city but was challenged earlier as a violation of church-state separation.  The city then sold the property, which abuts a public sidewalk, to the Fraternal Order of Eagles in order to maintain the display.  In a challenge made by the ACLU, the issue was whether the sale could be valid under state and federal law.  The court ruled completely in our favor.  We are waiting to see if the ACLU lawyers will file a notice of appeal to the full Seventh Circuit Court of Appeals or whether they will take the case up to the Supreme Court of the United States.  Over Christmas week, we filed our final brief in the Supreme Court Ten Commandments cases which are now set for oral argument in March.

 

On our radio broadcast this week, you will hear significant discussions about some of the ACLU agenda items for the coming year.  As I mentioned yesterday, we are mobilizing our team of lawyers around the country to defend cities, counties and citizens whose free speech rights are being infringed on by the ACLUs tactics.
