All eyes are on Fulton County right now as we have news that Judge Scott McAfee’s order in District Attorney Fani Willis’ disqualification hearing is imminent. Will she be removed from her Georgia election interference case against President Donald Trump?

If DA Willis (as well as her entire legal team) is removed from the case, the Governor will have to assign a new prosecutor. This prosecutor must then decide if it’s worth starting over from scratch – especially in light of President Trump’s securing the GOP nomination for the 2024 election. There’s a chance that this indictment against President Trump could be dismissed altogether.

Also, President Trump is at a federal courthouse in Florida today regarding Special Counsel Jack Smith’s indictment of the former President for mishandling classified documents at his Mar-a-Lago residence. Trump’s legal team will ask for the court to dismiss the 40 counts based on the Presidential Records Act.

ACLJ Senior Counsel Andy Ekonomou explained the motion to dismiss President Trump’s classified documents case:

Even if you assume that everything that you say in the indictment is true, still the government has not pled a crime. . . . The President designated the documents as personal, and the National Archives has no right to control or seize them, and no criminal proceeding can be brought. The motion . . . argues that judicial review by a court of the President’s decision to designate them is barred – can’t do it – based on separation of powers, and courts don’t have any authority to review even whether that classification decision was made properly or not. That’s up to the President. And if you want your records back, the way you get them is to go to court and file a civil action for recovery of the materials. But it certainly isn’t criminal.

As you know, Special Counsel Robert Hur’s probe in President Biden’s classified documents case was dropped. I explained yesterday that the Constitution forbids indicting a sitting President. But Hur even announced that he wouldn’t have indicted President Biden even if he had the authority to do so.

If the DOJ continues to pursue President Trump in the classified documents case, we clearly have a two-tiered system of justice at play. Neither of these cases should have ever been brought against either President. Yet President Trump’s enemies are willing to remove him from running for office by any means necessary.

I want to shift my focus to the Middle East. I’m very concerned about U.S. military engagement whenever it occurs, and of course, it’s inevitable at times. But we have the news that 1,000 U.S. troops will be in Gaza to build a floating pier for humanitarian aid. I have grave concerns that Hamas and the Houthis won’t sit idly by while our troops are in harm’s way.

Who’s going to provide the security for this aid as it lands? How will they ensure that it gets into the right hands? What do you do in the case of absolute chaos? You think of situations like Black Hawk Down, for example, in Somalia, and you can see how, very quickly, one unforeseen incident that should have been planned for – when things go wrong, anything is possible. And then we could end up with a serious not only loss of life but  . . . another geopolitical disaster.

I’m truly worried that we could be on the precipice of World War III. If our troops get attacked, the President would be forced to respond, which would likely plunge the U.S. into another war. Our troops are sitting on a potential powder keg.
