Free Speech

Remember when we told you how Facebook founder and CEO Mark Zuckerberg admitted that the Deep State approached his social media company and pressured them to censor certain stories that painted Joe Biden or his son Hunter in an unfavorable light or mentioned the infamous Biden laptop?

A federal judge just ruled that the Biden team has unconstitutionally been using social media platforms to censor the free speech of Americans and must stop immediately.

As reported by Politico:

A federal judge in Louisiana ruled Tuesday that the Biden administration likely violated the First Amendment by censoring unfavorable views on social media over the course of the coronavirus pandemic, calling the efforts “Orwellian.”

U.S. District Court Judge Terry Doughty also issued a sweeping preliminary injunction barring numerous federal officials and agencies — including Surgeon General Vivek Murthy, Health and Human Services Secretary Xavier Becerra, White House press secretary Karine Jean-Pierre and all employees of the Justice Department and FBI — from having any contact with social media firms for the purpose of discouraging or removing First Amendment-protected speech.

As the judge stated in his opinion: “During the COVID-19 pandemic, a period perhaps best characterized by widespread doubt and uncertainty, the United States Government seems to have assumed a role similar to an Orwellian ‘Ministry of Truth.’”

After Zuckerberg went public about the censorship efforts, the ACLJ took action, filing an urgent Freedom of Information Act (FOIA) request asking for all records related to meetings with social media companies. We demanded to know who called for this assault on free speech.

What makes this situation personal for the ACLJ is that not only did we report on Zuckerberg admitting to government pressure to censor conservatives, but we’ve also experienced it firsthand. Not only in direct ways but also by the apparent shadowbanning and quiet-throttling by the social media companies we use and even pay for advertising on. As my dad, ACLJ Chief Counsel Jay Sekulow, explained:

This is precisely what we’ve asserted in our litigation. I want to be clear here that we’re not just talking about something. We’re taking direct action on this, and we’re in federal court right now to get to the bottom of this. And once you get to the bottom of this, then you can get congressional oversight. Once you get congressional oversight, guess what; you get: change. That’s what happens. So that’s what we’re working on right now. . . . We are literally in federal court to get to the bottom of this.

But they put their thumb on the scale of what information they want you to get and what information they don’t want you to get. And, look, I remember the days when we’d have 10,000, 25,000, 30,000 people watching at any given time, this broadcast on Facebook. And over the course of 24 hours, it could be 1 million people, 800,000 people, which is more than CNN gets in their primetime viewing. Now we’re lucky if, over that 24-hour period, we get 25,000 people. So the thumb is on the scale.

By censoring conservative speech, the Biden Administration and the Deep State are actually just sowing more division in our country. Let’s be clear: The world is watching. The enemies of America love seeing us fighting amongst ourselves and establishing sides in our homeland. It’s just making the U.S. look weak, which also makes us vulnerable.

Today’s full Sekulow broadcast includes more discussion of the federal judge’s ruling to stop the Biden Administration from bullying social media companies into censoring opinions that dare to disagree with its agenda, let alone expose its unacceptable behavior. We’re also joined by ACLJ Senior Counsel and former U.S. Secretary of State Mike Pompeo, who offers his analysis of this latest development in the Left’s attempts to silence its critics.
