BREAKING: Hostile Takeover? Radical Left in Congress Announce Bill to Pack the Supreme Court | American Center for Law and Justice

The radical Left has announced a plan to pack the Supreme Court by hostile takeover.

The radical Left in Congress, led by Representative Jerry Nadler (NY) and Senator Ed Markey (MA), are circumventing President Biden – who we just told you announced an Executive order to appoint a commission to look into this very issue – by introducing legislation that would add four (for starters) new Supreme Court Justices.

As reported:

House and Senate Democrats . . . introduce[d] legislation Thursday to expand the number of Supreme Court justices to 13 from nine, drawing more attention to the debate surrounding court reform.

The bill, led by Sen. Ed Markey (D-Mass.) and Rep. Jerry Nadler (D-N.Y.), is the first legislation in recent years designed to add seats to the high court, and its introduction comes as progressive organizations are pushing for court expansion, after watching Senate Republicans fill three Supreme Court vacancies in four years under President Donald Trump.

At first look, even Speaker of the House Nancy Pelosi seems to have been caught off guard by this bill, called The Judiciary Act of 2021, as she has already responded that she’s not currently planning on introducing the bill on the House floor and that she still supports the President’s commission. But don’t let that fool you. This is a test balloon as the Court-packing commission gets going.

This apparent bucking of President Biden’s newly announced Presidential commission might almost reveal a disconnect within the current Democrat leadership, as our own ACLJ Senior Counsel Andy Ekonomou pointed out:

“They’ve already made up their mind. What’s the point of having a commission if you’ve made up your mind that you’re already going to expand the Supreme Court to thirteen Justices? And that’s exactly what has happened here. The commission seems to be redundant. There’s no need to have a commission if you’ve already decided that you’re going to expand the Court by adding four Justices. And it seems that there’s a disconnect perhaps between the White House and Congress in terms of what the plan is. But the Congress – [Representatives] Nadler, Hank Johnson, and [Senator] Ed Markey have already gone on and made their decision that they’re going to hostilely take over the Supreme Court of the United States, and that’s exactly what they’re doing.”

It’s important to make the distinction though, that even if it seems Rep. Nadler and company have gone somewhat rogue here, we firmly believe that President Biden, Speaker Pelosi, and even Sen. Durbin – Chairman of the Senate Judiciary Committee, who would only say, “I'm not ready to sign on yet” – would sign on in a heartbeat if they felt confident there would be no blowback.

As my dad, ACLJ Chief Counsel Jay Sekulow, put it:

“You’ve got to understand what this is. It’s pure politics. But it’s politics that’s very dangerous. You would give four appointments to the current President of the United States.”

Be clear; if they get away with increasing the Supreme Court from nine justices to thirteen, don’t be surprised if they then waste little time increasing the number to fifteen. Fifteen Supreme Court Justices, the last six all appointed by President Joe Biden, would all but guarantee the Left control over the Supreme Court for decades to come. It defies the principles of our Constitution.

ACLJ Senior Counsel for Global Affairs Mike Pompeo, who has served our country at the highest levels of government as Secretary of State, summed it up perfectly:

“Nine. It works. It’s constitutional. It reflects a central understanding about how the Constitution works, and checks and balances. This is a power grab. I remember they talked about us, in the Trump Administration, undoing institutions, [while they’re] trying to add a couple of states and trying to get rid of the filibuster. Now they’re going to try and see if they can’t convince enough Americans that the idea of packing the Court to their political bias is the right thing to do. This is at the center of the American tradition and we’ve got to do everything we can to stop it. I know the ACLJ will be very much at the center of this fight.”   

This bill is a direct threat to the Judiciary Branch of our government, and it’s a threat to the will of the American people.
