The radical Left’s crusade to ban former President Donald Trump from office rages on. Many prominent figures on the Left are arguing that Trump should be disqualified from being on presidential ballots in certain states. They are incorrectly invoking Section 3 of the 14th Amendment, which states no elected official may have participated in an insurrection or have “given aid or comfort” to anyone involved in an attempt to overthrow the government.

ABC News reports:

Democratic Sen. Tim Kaine of Virginia on Sunday said that he believes a strong legal argument can be made to use the 14th Amendment to remove former President Donald Trump from the ballot in 2024, citing Trump’s actions related to the Jan. 6 attack on the U.S. Capitol. . . .

“In my view, the attack on the Capitol that day was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power of as is laid out in the Constitution,” Kaine said Sunday in an interview with ABC “This Week” anchor George Stephanopoulos. “So I think there’s a powerful argument to be made.”

The 14th Amendment was ratified just a few years after the Civil War ended to ensure insurrectionists didn’t take office. Of course, the definition of an “insurrection” was pretty clear back in the 1860s, but the definition becomes much murkier the further we get away from the Civil War era. Trying to compare the Civil War to the events of January 6, 2021, is absurd. Also, how convenient is it that liberals in Congress all of a sudden now have a “proper” understanding of the Constitution for the first time?

If the Left is successful with this highly suspect constitutional theory, Trump won’t be on the ballots in a handful of states after Secretaries of State in different states decide to go along with the electoral ploy. All that the Left would need are five or seven states (or swing states) to decide they don’t want Trump on the state’s 2024 presidential ballot. Don’t forget that Trump has never been formally charged with insurrection. This would be far-Left state officials unilaterally declaring Trump to be an insurrectionist. No adjudication. No judge. No jury. Just the Left declaring him “disqualified” for office.

And if the Left could do that to Trump (without going through proper legal channels), what else could they do to interfere in future elections? The election would be over before it even started. Is this not election interference by the Left?

I know so many people lost faith during the last election cycle. I’ve been adamant in saying that we must fight back and ensure that voting laws are in place for a fair election. This is a clear example of why it’s so important that conservatives speak out and defend the Constitution and our electoral process.

Citizens can act to ensure a fair election. They can reach out to their elected officials and petition the government for redress of grievances. They can petition their Governor or Secretary of State not to engage in this unconstitutional practice.

Also, the ACLJ is preparing to send a legal letter to all 50 states' Secretaries of State, putting them on notice that such an abuse of the 14th Amendment is unconstitutional. And we will be ready to file legal briefs and lawsuits on behalf of citizens having their right to vote for the candidate of their choice usurped by this blatant election interference.  

We will have a constitutional crisis on our hands if the Left goes down this road. The ACLJ will start working on the issue today to prepare for what could lie ahead. The future of our democracy is at stake, and we will be ready to fight.
