Surprise. Surprise. The latest Special Counsel assigned to investigate former President Donald Trump actually has a history of targeting conservatives.

As reported late Friday afternoon by Fox News:

Attorney General Merrick Garland on Friday named a special counsel to investigate the entirety of the criminal probe into the unlawful retention of national defense information at former President Donald Trump’s Mar-a-Lago resort, Fox News has learned.

Garland appointed former Justice Department official Jack Smith to the role. Smith, a former assistant U.S. attorney and chief to the DOJ's public integrity section, will oversee the investigation into Trump's retention of classified documents after leaving the White House and whether the former president obstructed the federal government's investigation into the matter.

Smith is also tasked with overseeing the investigation into whether Trump or other officials and entities interfered with the peaceful transfer of power following the 2020 presidential election, including the certification of the Electoral College vote on Jan. 6, 2021.

In fact the selected Special Counsel, Jack Smith, who was appointed of course by Biden’s Attorney General Merrick Garland to investigate President Trump, was one of the lawyers at the Department of Justice (DOJ) who worked with Lois Lerner to investigate some of these conservative groups, specifically members of the Tea Party, to essentially see if there are potential criminal activities (regardless of any evidence) that they could bring forward criminal charges and shut them down.

Early on, one caller actually asked what is the predicate to appoint a Special Counsel, which was a great question. As we all know, this isn’t President Trump’s first go-round with a Special Counsel. And a number of people have asked why an Attorney General feels it necessary to appoint a Special Counsel in the first place.

The way it works under the law is the sole determinative person who has the authority to name a Special Counsel is the Attorney General, which in this case is of course Merrick Garland. It means the DOJ may be conflicted, or there were concerns of conflicts which would require an in-house counsel to recuse himself, even including the AG himself.

And based on AG Garland’s own words, it sounds like no coincidence that he has appointed this Special Counsel right after former President Trump announced his third run for President of the United States in the 2024 election:

"It is in the public interest to appoint a special prosecutor to independently manage an investigation and prosecution based on recent developments, including [Trump's] announcement that he is a candidate for President in the next election and the sitting President's stated intention to be a candidate as well," said Garland.

So is this latest investigation, much like the actual Mar-a-Lago raid itself, this is just another anti-Trump witch hunt to keep him from winning back the White House?

Now for his part, Smith has promised a fair, independent investigation into President Trump and any alleged documents or other wrong-doing that he may have been accused of by the Left. As Smith said upon accepting the position:

I intend to conduct the assigned investigations and any prosecutions that may result from them independently and in the best traditions of the Department of Justice," Smith said. "The pace of the investigations will not pause or flag under my watch. I will exercise independent judgment and will move the investigations forward expeditiously and thoroughly to whatever outcome the facts and the law dictate."

Folks, as an attorney with some experience under my belt, let me tell you I realize often charges do stem from investigations, but it sure sounds like Mr. Smith already has his marching orders to find and charge, whatever it takes. Of course, Robert Mueller had his orders too, and remember what he found – nothing. No charges. That’s how due process is supposed to work. We will be closely monitoring this investigation and keeping you up-to-date at every turn.
