ACLJ Files Expedited FOIA Demanding Records on Classified Documents President Biden Has Been Hiding, and Who Else Knew

President Biden’s hypocrisy has to be exposed and shut down now. Attorney General Merrick Garland just appointed a Special Counsel to investigate the President. And at the ACLJ, we are taking action, launching our own investigation.

President Joe Biden, who railed against President Trump and called him “irresponsible” for keeping classified documents in his personal residence, has now in the span of a few days been caught red-handed hanging on to highly classified documents that should be securely stored in the National Archives. What’s certain is that these sensitive files are not supposed to be found inside the closet of a personal office Biden used after his tenure as Vice President, six years ago, and now more classified documents have been found in Biden’s own home garage.

We already know some of these documents were of the highest levels of classification, including Sensitive Compartmented Information (SCI) apparently containing sources and methods, and that some of the topics included Iran and Ukraine.

But don’t worry, because the President wants us all to remember that his garage is usually locked. After all, this latest batch of documents was discovered near his precious classic Corvette. When news of the first batch of classified documents finally made its way to the rest of us, Biden pleaded ignorance, saying he was “surprised” and had no idea what was contained in the documents. Now another set of classified docs has been discovered right near his car that he’s clearly so proud of, and yet he never knew they were there? Sorry, but I don’t buy it.

President Biden claims that everyone knows he takes classified documents very seriously, but honestly, I don’t see how anyone could possibly believe that. He’s leaving a clumsy trail of unsecured classified documents all over the place. And don’t be surprised if even more surface before too long. The President isn’t coming clean.

That’s why the ACLJ JUST FILED an EXPEDITED Freedom of Information Act (FOIA) request, demanding all records and communications between the National Archives (NARA) and the Biden Team regarding these documents. Did the NARA know Biden had them, and if so, for how long? Did Biden tell the NARA that he had given them all the records? And that's just the tip of the iceberg.

As our critical FOIA states:

According to CBS News, and which has since generated universal media coverage, records covered by the Presidential Records Act, and which included some number of classified records, were located at the Penn Biden Center for Diplomacy and Global Engagement, on November 2, 2022. Since then, additional information is being reported, including that additional boxes of records have been identified in different locations, and regarding the topics of the hidden records.

This FOIA Request does NOT seek the actual records discovered, but instead, all communications between the NARA and Biden or his team regarding the disposition of presidential records from his 2009-2017 term as Vice President, whether classified or unclassified, and some ancillary NARA records.

While Attorney General Garland has now finally appointed a Special Counsel, the problem is, he knew about the Biden docs last year (right before the midterm elections) and waited until it became public knowledge to take action against his boss, seemingly incongruous with his position.

Biden clearly took these documents when he left the White House as Vice President. It has been reported that they involve Iran and Ukraine. Ukraine is, of course, the subject of the first impeachment trial of President Trump. It would have been nice to know what they contained. And as President Biden has been courting Iran since before taking office, it’s very concerning what might be found in those files, too.

The bottom line is this is offensive hypocrisy of the utmost degree; and on top of that, Biden has been extremely flippant about it while he was also one of the loudest voices calling for President Trump to be prosecuted FOR THE SAME THING. In fact, the time span, the topics, his position as merely Vice President without declassification authority, and how they were haphazardly stored in various locations, could all make Biden’s situation far worse.

At the time of this writing, there’s been no FBI raid on President Biden’s home. No one has taken his passport away. And there have been rumors of still more classified documents in Biden’s possession that may come to light soon.

What is in these documents and who has seen them? Why is President Biden being treated differently? The American people deserve to know what’s being hidden from us now. The Biden Administration must be held accountable for its blatant hypocrisy and lawless behavior. Our FOIA will help do just that. And we stand ready, willing, and able to take this to federal court if the Biden Deep State tries to cover it up, ignores the law again, and refuses to comply with our FOIA request.
