ACLJ Fighting for Medical Workers Being Forced To Abort Babies

Can you imagine being forced to perform an abortion at work? At Presbyterian Hospital in New Mexico, three ultrasound technicians are being forced to assist in abortions. If the technicians refuse to participate in killing the unborn, then they could lose their jobs.
If this malicious attack on religious conscience can occur in New Mexico – in a hospital that had never performed abortions prior to new ownership in 2024 – it can happen anywhere. No one should ever be forced to end the life of a child. That’s why the ACLJ is getting involved.
You can bet this growing attack on forcing Christian medical professionals to assist in abortions stems from the Biden-Harris Administration. In fact, in an interview with NBC News, Vice President Kamala Harris doubled down on removing “religious exemptions” for Christian doctors and nurses.
Harris stated: “I don’t think we should be making concessions when we’re talking about a fundamental freedom to make decisions about your own body.” She later added that America needs to “put back in the protections of Roe v Wade.”
ACLJ Senior Counsel CeCe Heil explained how federal law protects employees from having their religious conscience violated:
If you have Christian values and beliefs of protecting life, these conscience laws outside of Roe v. Wade – what Kamala Harris is talking about – there are actually federal laws protecting the conscience exemptions. . . . And in the Supreme Court case FDA v. Alliance for Hippocratic Medicine, which was the mifepristone (abortion pill) law, the Supreme Court – in an opinion written by Kavanaugh –unanimously said conscience rights are protected. You cannot force a doctor or a medical professional to perform an abortion.
Because the hospital receives federal funding, it must abide by the federal conscience laws that, in the words of the Supreme Court, “allow doctors and other healthcare personnel to ‘refus[e] to perform or assist’ an abortion without punishment or discrimination from their employers.”
Further, the hospital cannot force them to assist in abortions in emergency situations. The Supreme Court has noted that the Emergency Medical Treatment and Labor Act does not override federal conscience laws.
By changing its policies, Presbyterian Hospital has violated its employees’ right to a religious accommodation. Such rights are protected under Title VII of the Civil Rights Act of 1964, which forbids an employer from discriminating against an employee based on religious beliefs. Thus, the three ultrasound technicians should never be forced to choose between losing their jobs or compromising their faith.
So how is the ACLJ helping these pro-life technicians who are under attack? We just sent a demand letter to the hospital that explains how the new policies violate federal law and Supreme Court precedent. If the hospital does not reverse course, then we are prepared to take legal action.
