Hawaii Loses to President Trump Again; This Time at the 9th Circuit

As an update to what we explained earlier today, the State of Hawaii was rebuffed by a federal trial court yesterday in the State’s efforts to have that court clarify the United States Supreme Court’s modification of the injunctions imposed against the President’s national security Executive Order.

The Hawaii federal trial court rejected Hawaii’s attempt to bypass the Supreme Court and directed the State to seek relief in the Supreme Court itself.

Instead of following the trial court’s guidance, the State of Hawaii today filed an emergency appeal in the Ninth Circuit Court of Appeals. This evening, the Ninth Circuit dismissed the appeal for lack of jurisdiction and denied Hawaii’s request for appellate relief.

The Supreme Court’s decision enforcing critical parts of the President’s national security Executive Order remains in force.
