Shocking Leak From FBI Classifying "Misinformation" as an "Election Crime"

We’ve received new information about attacks on election integrity from within the Biden Administration. An FBI whistleblower provided a document to Project Veritas that reportedly shows the FBI classifying “misinformation” as an “election crime.”

Imagine that, just before a critical Midterm Election.

The document claims that the FBI is looking into these so-called election crimes. Now usually when you hear about election crimes, it’s pretty clear. Most laypeople can understand what the crime is and why it’s wrong. But this document includes not only terms we’re not even allowed to use on social media like “voter ballot fraud.”

But they also list both misinformation and disinformation. According to this FBI document,  disinformation is defined as “false or inaccurate information intended to mislead others.” That is still very broad and ripe for misinterpretation. But it gets worse. It also says they are investigating “misinformation, which according to the FBI any false information – whether it was spread mistakenly or unintentionally – falls under this definition of a crime.

It’s absurd. And they’re going after Americans. They’re going to be combing through social media, scrutinizing posts.

First of all, let’s be clear about one thing, if it’s a crime, it requires proof of intent. Yet by the looks of this document, it appears there’s no need to show intent to commit a crime anymore.

As ACLJ Senior Counsel Andy Economou explained, you cannot be accused of a crime without proof of intent and gave a few chilling examples of how this new FBI policy could have chilling results for Americans:

There are two components of a crime. I know a little bit about this because I was chief of the criminal division of the U.S. Attorney’s Office in Atlanta for five years. The two components of a crime are an evil act and an evil mind. You’ve got to have the actus reus and the mens rea in Latin. You’ve got to have intent to commit a crime. You cannot commit a crime, you cannot be guilty of a crime, you should not be prosecuted for a crime where you have acted in a manner that is by mistake or without intent. If you were to say to somebody for example that the voting poll place closes at 6 o’clock when in fact you were mistaken and it closed at 7 o’clock, and that person didn’t get to vote because they relied on you, you could be guilty of a crime here. Or if you could say that the library is not a polling place anymore when in fact it is and that person doesn’t vote because they thought that you had given them the correct information when you were mistaken and had no intent, you could be guilty of a federal crime according to this so-called cheat sheet.

The FBI cheat sheet also includes campaign finance and election interference, which by the way is already against the law.

But let’s be honest whenever the Left says disinformation or misinformation, there’s one group they’re actually talking about, and I’d wager if you’re listening to Sekulow or reading this article, you’re probably already in it.

Remember that this same Biden Administration attempted to prop up a so-called “Disinformation Governance Board” until the overwhelming objections from the American people were too loud to ignore, at least for now.
