Grand Jury Forewoman Destroys Case Against Trump
As the old adage goes, “Loose lips sink ships.” Maybe it’s time to get that back into the current lexicon, because the indelicate grand jury forewoman in the Georgia grand jury probe into former President Donald Trump may have just torpedoed the entire proceeding.
Emily Kohrs, the 30-year-old forewoman of the Georgia grand jury tasked with determining if criminal activity took place during the 2020 presidential election, went on a media tour, and treated it more like an audition for American Idol. Kohrs acted giddy and silly as she discussed deliberations over indictments on major news programs, in diametric opposition to the oath she took to protect the secrecy of the proceedings and uphold the integrity of the federal legal system.

The revelation that the Georgia special grand jury investigating election interference by Donald Trump and his allies in the state recommended indictments for multiple people on a range of charges in its final report could jeopardize the former president's prosecution, experts have said.
The information was leaked by Emily Kohrs, a forewoman of the Georgia grand jury, on Tuesday night. Most of the jury’s final report remains officially sealed.
During interviews with the likes of The Associated Press and the New York Times, Kohrs revealed that the number of people recommended for indictment by the jury for meddling with Georgia’s 2020 presidential election “is not a short list.”
Kohrs avoided directly confirming specific names when asked, but the footage speaks for itself. She might as well have given a wink and a nod to the camera. The judge cautioned every member of the grand jury against speaking about the case, and each member, including Ms. Kohrs, was given a conduct handbook that specifically instructed them not to reveal the details of the proceedings. She took an oath to uphold those rules.
According to Georgia Code 15-12-67, which lists the oath of foreman and grand jurors:
[Y]ou shall keep the deliberations of the grand jury secret unless called upon to give evidence thereof in some court of law in this state. You shall present no one from envy, hatred, or malice, nor shall you leave anyone unpresented from fear, favor, affection, reward, or the hope thereof, but you shall present all things truly and as they come to your knowledge. So help you God.
She literally said she would be sad if certain individuals are not indicted. That’s exactly what the oath she took told her NOT to do. Watch for yourself, and you’ll likely be infuriated. Kohrs appeared jovial, even coy, and at times grinning and mugging for the camera, as if sharing some inside joke with the journalists.
Kohrs reportedly sketched portraits of witnesses as they were deposed, including writing some of their names, and shared them with others, including a former Georgia state attorney who Kohrs claims complimented her artistic talents. Her behavior is reprehensible. Even the traditionally anti-Trump mainstream media is flummoxed by this inexcusable lapse in judgment, knowing the damage Kohrs has likely done.
This entire grand jury has been tainted, turned upside down in a media circus. The entire proceedings have to be thrown out. And there could be criminal consequences for Ms. Kohrs.
My dad, ACLJ Chief Counsel Jay Sekulow, gave an impassioned argument for why this is so frustrating, so dangerous to the American judicial system, and so detrimental to American citizens:
This is a high-stakes, high-profile criminal investigation of the former President of the United States, conducted by a local district attorney. This is exactly what I argued to the Supreme Court should not be happening . . . and I have to tell you something, the foreperson of a grand jury saying she will be sad if something is not done – and she’s saying this on TV – and they have all these charges they could bring. Here’s the other problem with this, and I want people to be clear on this, and this is where the outrage is: Peoples’ liberty is at stake. People’s lives will be forever changed if they’re indicted by a grand jury. And they’re making a joke out of this, in Atlanta, Georgia. Grow up.
As far as I can see, this is the death knell for the prosecution’s case. We clearly expect former President Trump’s legal team to go into court today and demand the entire investigation be thrown out.
