ACLJ Wins Victory for Whistleblower Marcus Allen, FBI Reinstates His Security Clearance in Full

The ACLJ has achieved a major victory on behalf of Marcus Allen, an FBI employee retaliated against for merely cautioning his superiors about ensuring their public narrative matched the facts. In a major and unprecedented settlement, Marcus Allen’s security clearance was fully restored, allowing him to finally obtain new employment, and he has finally been vindicated and received justice after being unjustly targeted by the Biden Deep State for blowing the whistle on potential corruption.
As a Marine, Marcus Allen served bravely in Iraq, receiving numerous awards and medals for his service. Since 2015, he has worked for the FBI’s Charlotte Office, where he has performed excellently and was even awarded as an employee of the year. But when he sent an email to his superior, highlighting for situational awareness a matter where he believed FBI Director Christopher Wray had potentially been dishonest in congressional testimony, his security clearance was suspended, and then he was suspended from duty and pay. Then the FBI revoked his security clearance.
As a result, he was caught in a terrible Catch-22, where he was barred from working for the FBI while simultaneously not being allowed to take any outside job or even receive gifts – because he was still technically considered an FBI employee. The FBI trapped Marcus Allen in a situation where he had no means of providing for his family and was left stuck waiting for them to act. For nearly two and a half years, Marcus went without pay (he couldn’t even accept gifts because he was technically still an FBI employee), enduring the full vindictive force of the FBI Deep State.
But that has all changed as a result of this historic settlement. His security clearance has been reinstated, and he has received the back pay and benefits he was due. Marcus Allen has been vindicated.
We worked alongside Empower Oversight to pursue several ongoing methods of accountability against the FBI, including administrative complaints with the Department of Justice Office of the Inspector General and an ongoing First Amendment lawsuit in federal court. In this new agreement, Allen agreed to end those complaints and to end the lawsuit in exchange for the provision of his total back pay and even reimbursement for things such as health insurance and retirement benefits. The FBI would not admit explicitly that this settlement also included the security clearance, but it did; as part of making Marcus Allen whole, the FBI is restoring full security clearance to him and even providing him with a letter of good standing.
The ACLJ is very pleased to have been part of this victory for Marcus Allen, working with our friends at Empower Oversight. We can’t undo what the Biden FBI forced Marcus to endure, but we were able to help him achieve justice and vindication. Now he and his family can put this horrendous chapter behind them and move forward. We applaud their bravery and sacrifice. This settlement is a huge vindication for Marcus and a demonstration that his security clearance, and ultimately his employment, was not properly revoked.
Unfortunately, Allen is not the only brave whistleblower who needs help. Our ongoing representation of FBI whistleblower Garret O’Boyle continues in full force, and our reply brief in the U.S. Court of Appeals for the D.C. Circuit is due this coming Friday. Because of the victory we achieved in getting past the FBI’s motion to dismiss our appeal, we will be able to defend O’Boyle’s case on the merits at that court.
