HERE'S WHY

In 2021, two Yemeni nationals, both on the FBI Terrorism Watchlist, were apprehended by U.S. Customs and Border Protection (CBP) agents at two separate times as they attempted to cross our southern border.

CBP officials posted a press release detailing the capture, but Biden Administration officials shut them down, demanding the press release be removed, undermining our border agents who put their lives on the line.

YOU WERE NOT SUPPOSED TO KNOW ABOUT IT

These arrests exposed the incompetence and inaction of Biden’s failed immigration policies that created this crisis and left America exposed and vulnerable to attack. After hearing about the scrubbed press release, the ACLJ filed a Freedom of Information Act (FOIA) request against FOUR Biden agencies demanding answers. Now we’ve received a flood of records from DHS, which have only confirmed our suspicions – the Biden Administration didn’t want you to know about the arrests.

33-year-old illegal Yemeni immi- grant on FBI’s Terrorism Watchlist and No-Fy list apprehended by border patrol three miles west of the Calexico Port of Entry just after 1:00 AM.
MAR. 30, 2021 MIDNIGHT
Second Yemeni terrorist apprehended
26-year-old illegal Yemeni immigrant on FBI’s Terrorism Watchlist and No-Fly list apprehended by border patrol two miles west of the Calexico Port of Entry just before midnight.

First email was sent from CBP Deputy Assistant Commissioner to DHS’ Public Affairs Assistant Secretary Marsha Espinosa inquiring “how” the alert “got released without a heads-up.”

ACLJ SUBMITS FOIA REQUEST
Our critical Freedom of Information Act request stated, “FOIA Request to U.S. Customs and Border Protection (CBP) For Recordings Regarding Border-Related Human Trafficking and Exploitation of Women and Children, the Cancelation of Postponement of Operation Talon, and taking down CBP’s Press Release on Arrest of Persons on the FBI’s Terrorism Watchlist.”

ACLJ SUES DHS, CBP & ICE
The ACLJ filed a lawsuit against the Department of Homeland Security, Customs and Border Protection, and United States Immigration and Customs Enforcement for failing to comply with our Freedom of Information Act request. None of the letters submitted by the agencies contained the required pieces of information, and the 20 business day deadline to file responses had passed.

BIDEN COVER-UP EXPOSED
Through our lawsuit, the ACLJ obtained critical records showing that senior officials, including someone who is now a “principal advisor” to Secretary of Homeland Security Mayorkas, worked through the night to get the press release on the capture of two Yemini terrorists at the U.S. southern border scrubbed, coordinating efforts with unknown senior FBI and Customs and Border Protection officials.

Not only has Biden ignored the disaster at the border – passing the buck to Vice President Harris, a disastrous move in itself – but Biden’s policy of no policy has only increased the threats to Americans. As he promised, Biden stopped the construction of Trump’s border wall, leaving massive gaps. He pushed to end Title 42, the pandemic policy that prevented millions of undocumented migrants from entering. And most recently, the Biden Administration cut the critical “aerostats” security program that used remote blimps to help CBP agents spot bad guys before they could cross the border.
