Today we witnessed the live shredding of the Constitution by the House Intelligence Committee.
On today’s Jay Sekulow Live, we discussed House Intel Chairman Adam Schiff’s blatant misrepresentation of the transcript of the phone call between President Trump and Ukrainian President Zelensky at the Committee hearing. In our analysis, the whistleblower complaint is complete hearsay and would not be admissible in court.
Today Rep. Schiff opened his hearing by reading a fake transcript he created misrepresenting a conversation between President Donald Trump and the Ukrainian leader, because the real thing does not support his false narrative. He made up a false transcript, openly admitting it was complete fiction, in order to make the conversation look bad.
Below is the fictional “parody” the House Intel Chairman presented at the beginning of the hearing – NOT the actual transcript:
This is the essence of what the President communicates, “We’ve been very good to your country, very good. No other country has done as much as we have. But you know what? I don’t see much reciprocity here. I hear what you want. I have a favor I want from you, though, and I’m going to say this only 7 times, so you’d better listen good. I want you to make up dirt on my political opponent, understand? Lots of it. On this and on that. I’m going to put you in touch with people, not just any people...I’m going to put you in touch with the Attorney General of the United States, my Attorney General Bill Barr. He’s got the whole weight of the American law enforcement behind him. And I’m going to put you in touch with Rudy, you’re going to love him, trust me. You know what I’m asking, and so I’m going to say this a few more times, in a few more ways, and by the way, don’t call me again. I’ll call you when you’ve done what I’ve asked.” This is, in some in character of what the President was trying to communicate with the President of Ukraine. It would be funny if it wasn’t such a graphic betrayal of the President’s oath of office.
The difference is stark between what he said and the actual transcript that we went through line by line yesterday. Rep. Adam Schiff completely made up a phony exchange between President Trump and President Zelensky out of thin air. Adam Schiff shredded the constitution today.
But that’s how far the Left is willing to go to damage President Trump – a President who stands up for religious liberty, for the persecuted, for the unborn, for Israel, for the American taxpayer, for American businesses, for border security, and for our military.
We moved on to the so-called whistleblower complaint, which all of us on the show agreed was flimsy and a document that would not be admissible in court.
ACLJ Senior Counsel Andy Ekonomou made a strong, succinct observation:
I looked at this the way a lawyer does. Is this admissible in court? When you look at the statement that the so-called whistleblower wrote on the first page of the complaint: “I was not a direct witness to most of the events described.” That’s all I have to hear. Objection, hearsay. Sustained.
That means that what the whistleblower “knows” he heard from somebody else or somebody else told somebody else.
ACLJ Director of Policy Harry Hutchison pointed out: “One of the issues here is the hearsay. Also this particular whistleblower’s testimony lacks credibility because the Inspector General found that he was infected by political bias.”
The complaint is nothing but hearsay upon hearsay upon hearsay and would not be admissible in any court. It certainly shouldn’t have been the subject of a congressional hearing.
This hearing was disingenuous political theater.
