President Obama today named Solicitor General Elena Kagan as his nominee to replace retiring Supreme Court Justice John Paul Stevens.

If confirmed, Kagan would become the first Justice to the Supreme Court in nearly 40 years who has no previous judicial experience.

This fact underscores the importance of closely examining her judicial philosophy - will she abide by the Constitution, or will she take an activist view?

While no nominee should express legal opinions concerning specific issues, the American people deserve to know whether this nominee who could serve for many decades embraces the philosophy of judicial activism.
