Another Supreme Court Win

We received news this morning that the Supreme Court of the United States granted certiorari in our companion case to Pleasant Grove City v. Summum today.  In Duchesne City v. Summum, a Ten Commandments monument similar to that of Pleasant Groves was challenged by Summum.  Summum, of course, brought the main challenge to the Ten Commandments monument located in Pleasant Grove.

 

As we reported last week, the Supreme Court ruled unanimously in our favor, overturning the Tenth Circuit Court of Appeals.  This morning, the Supreme Court issued a summary disposition in Duchesne City.  The Court stated the following:

 

            The petition for certiorari is granted.  The judgment is vacated and the case is remanded to the United States Court of Appeals for the Tenth Circuit for further consideration in light of Pleasant Grove City v. Summum, 555 U.S. ___ 2009. 

 

This is very good news. These summary dispositions, called GVRs (short for granted, vacated, and remanded),  have significant impact on the development of the law in the lower courts once a Supreme Court decision has been issued. Considering that the Tenth Circuit ruled against us in the Duchesne City case, the fact that our petition for certiorari has been granted and that the judgment has been vacated and sent back to the Tenth Circuit is great news.  Click here to read my posting last week concerning the Pleasant Grove case, which applies to Duchesne as well.
