Today we filed an amicus brief on behalf of 33 members of the United States Congress in the ongoing litigation involving the war memorial at Mt. Soledad.  The war memorial, which has been in existence since the 1950s, contains a large cross as well as other symbols of sacrifice.  This war memorial has been part of the landscape in San Diego for over 50 years.  A year and a half ago, President Bush signed a bill passed by Congress that transferred the land to the federal government, and specifically to the Department of Defense.  The Department of Defense accepted the property from the City of San Diego and continues to maintain this historic war memorial. 

 

Despite several recent victories in federal court, we are still continuing to file briefs as the litigation moves into different phases.  Currently, there is a challenge regarding the legality and constitutionality of the transfer of the property from the city of San Diego to the federal government.  Our brief deals specifically with that issue.  We are explaining Congresss rationale for moving this legislation forward.  We are pleased to represent 33 members of Congress.  If you would like to read our brief, click here.
