The Americans United for Separation of Church and State filed the suit because they claim it forces non-Christians to enter a house of worship, and violates the law against a government endorsement of religion.  Chief Counsel Jay Sekulow fired back at the group reminding them that a church service will not be held at the local church, but rather a traditional graduation ceremony will take place.  Sekulow said the filed complaint argues with the theological beliefs of the church, but Sekulow reiteraretes that the facility was chosen because it is able to hold a larger crowd.  Watch the debate here.
