Harriet Miers Withdraws Nomination to Supreme Court

By letter this morning, White House Counsel Harriet Miers notified the President that she was withdrawing her nomination to be an Associate Justice of the Supreme Court of the United States.  In her letter, she said that members of the Senate have indicated their intention to seek documents about my service in the White House in order to judge whether to support me.  I have been informed repeatedly that in lieu of records, I would be expected to testify about my service in the White House to demonstrate my experience in judicial philosophy.  While I believe that my lengthy career provides sufficient evidence for consideration of my nomination, I am convinced that efforts to obtain Executive Branch materials and information will continue.  She went on to say that shes not comfortable with the Executive Branch material being released because its covered by Executive privilege.  Protection of the prerogatives of the Executive Branch and the continued pursuit of my confirmation are in tension.  I have decided that seeking my confirmation should yield.

 

The President is now in a position to select another nominee to the Supreme Court of the United States.  I anticipate that this will be another conservative judicial nominee who is put forward for this position.  We will keep you posted as facts develop today.
