Our Partisan Bureaucracy — Lawyers Love President Obama
Thanks to the TaxProf blog and to Instapundit, I discovered this chart detailing political giving by government lawyers: With certain limitations understood (we don’t know the affiliations of non-donors), the chart above looks more like the political affiliations of Ivy League women’s-studies departments than those of an allegedly impartial federal bureaucracy. The civil-service system was designed to replace the spoils system, which — in addition to creating chaotic rushes... Continue Reading

The Private Corporation as Public Agency
As my ACLJ colleagues prepare to file their next round of briefs in the HHS mandate cases, I’ve been struck once again at how many Obamacare supporters are just aghast that a for-profit company would dare to assert its own rights against a federal regulation. In speeches and other public events, I’ve been pressed again and again: “Of course the government can regulate for-profits. If you win your cases, what’s next? A right to use child labor? A right to operate an unsafe... Continue Reading

Another Victory Against the Abortion Pill Mandate
Yesterday, the D.C. Court of Appeals issued a major victory in the ongoing litigation battle against the HHS Mandate, the government edict mandating that employers pay for abortion-inducing drugs in employee health plans. The case involved two religious institutions: Belmont Abbey College, a Catholic college in North Carolina, and Wheaton College, an Evangelical college in Illinois. The colleges independently sued the federal government earlier this year claiming that, among other things, the H... Continue Reading

Ninety Seconds of Truth – American Weapons for the Muslim Brotherhood
As Jay explained Tuesday, the United States government is set to deliver 20 advanced fighters and 200 advanced main battle tanks to Egypt’s Muslim Brotherhood government. These weapons – purchased by American taxpayers when American allies ruled Egypt – will still be delivered despite the fact that the Muslim Brotherhood is not only a sworn enemy of America and Israel but has actually inspired terrorist attacks across the world. In fact, the current leader of al Qaeda has lon... Continue Reading

2012 Victories: Protecting Churches
This is the latest installment in a year-end series looking back at a few of the hundreds of victories by the ACLJ in 2012. This year churches have suffered significant threats from government intrusion both internationally and even here in the United States. It goes without saying that churches must be free to select not only their leaders, pastors, priests, etc., but also their employees based on their beliefs and willingness to hold true to the religious principles of the church. It goes wi... Continue Reading

Victory: Street Evangelists Exonerated, Free Speech Protected
While they could be enjoying a sporting event, taking in a movie, or just relaxing after a long week, three residents of McDonald County, Missouri, have instead chosen to spend their summer weekend evenings sharing the good news of Jesus Christ along Main Street in the City of Noel. And although the Founding Fathers may have recognized the importance of protecting such religious speech when they ratified the First Amendment, Noel city officials took a different approach, issuing the men criminal... Executive Privilege: What Does the Case Law Say?
President Obama’s assertion of executive privilege over certain Fast and Furious-related documents generated in the aftermath of a now-famous (and inaccurate) February 4, 2011 letter to Congress that misstated the nature and extent of the gunrunning program has profound political and legal implications. The political implications are fairly clear. It’s a real scandal now. For two years Fox News, conservative journalists, and conservative congressmen have been doggedly chasing dow...
