WWII Veteran: To Tear Down Jesus Statue “Would Tear Me Down”
World War II veterans, Congressmen, and concerned citizens met together yesterday to discuss the war memorial statue of Jesus that is the center of an atheist lawsuit. The Freedom From Religion Foundation calls the nearly six decades old war memorial “a sham” and literally made a federal case of the matter filing suit to have it torn down. The memorial was placed by members of the U.S. Army’s 10th Mountain Division upon returning home as a reminder of the many similar statues... Continue Reading

Constitutional Confusion to Persist After SCOTUS Rejects Utah Case
It is disappointing that the Supreme Court failed to take a very important case out of Utah - a case involving the placement of crosses along Utah highways to commemorate the death of Utah Highway Patrol officers and a reminder to urge motorists to drive safely. This is a case that we've been involved in for quite some time. The kind of issue we discuss regularly. A federal appeals court determined these highway crosses were unconstitutional. The case was appealed to the U.S. Supreme Court a... Continue Reading

UPDATE: Mt. Soledad Brief Filed
Thanks to the thousands of you who signed on to our Petition to Preserve the Mt. Soledad Cross Memorial in San Diego. We have just filed our amicus brief in support of the federal government's request that the full U.S. Court of Appeals for the Ninth Circuit rehear a case in which a three-judge panel of the Ninth Circuit declared that long-standing memorial unconstitutional. We believe strongly that this is an opportunity for the entire appeals court to correct a mistake made by a three-judge ... Continue Reading

Protect the Mt. Soledad Cross
We are not giving up. You may recall, a three-judge panel of the U.S. Court of Appeals declared the long-standing Cross Memorial at Mt. Soledad in San Diego in January unconstitutional. As you know, the ACLU is behind this litigation and spent years trying to get this memorial removed. Now, we're preparing for the next phase - urging the federal appeals court to reconsider the decision and permit a full panel of the appeals court to consider the case. We're preparing that critical amicus b... Continue Reading

A Faulty Ruling Targets San Diego Cross
It's disappointing, but comes as no real surprise. A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit has declared the long-standing war memorial cross on top of a San Diego mountain unconstitutional - a violation of the Establishment Clause of the First Amendment. As you may recall, we've been involved in this case for years - fighting to ensure that the cross survives legal challenges that now span decades. The decision represents a judicial slap in the face to the count... Continue Reading

SCOTUS Urged to Back AZ Tuition Tax Credits
We have filed an amicus brief at the Supreme Court of the United States in defense of the state of Arizona's tuition tax credit program. It's an important case that has significant ramifications. The brief argues that a lawsuit challenging the program should be dismissed because those bringing the suit do not have legal standing to challenge the tax credits in this case. Strict church-state separationist taxpayers in Arizona are challenging the program under the Establishment Clause of the First Amendment. The U.S. Court of Appeals for the Ninth Circuit last year ruled against the tax credits, but the Supreme Court has agreed to review the case which is entitled Arizona Christian School Tuition Organization v. Winn. The fact is that the Arizona tuition tax credit program has been a huge boon to school choice. The program has grown every year, and the interest from parents is phenomenal. This is exactly the sort of program of private choice that enables parents to choose the school... Continue Reading
