Our Partisan Bureaucracy — Lawyers Love President Obama
Thanks to the TaxProf blog and to Instapundit, I discovered this chart detailing political giving by government lawyers: With certain limitations understood (we don’t know the affiliations of non-donors), the chart above looks more like the political affiliations of Ivy League women’s-studies departments than those of an allegedly impartial federal bureaucracy. The civil-service system was designed to replace the spoils system, which — in addition to creating chaotic rushes... Continue Reading

President Obama’s War Strategy Requires a Security State — And He Knows It
Let’s begin with a simple proposition: America faces a remorseless, savage jihadist enemy that is seeking — under the guise of various organizations and support structures — to kill as many Americans as it possibly can. Given the existence of this enemy, only the suicidal or the foolish refuse to defend themselves. At the risk of over-simplifying, assuming we are not suicidal or (entirely) foolish, our methods of self-defense can be offensive in nature, defensive in nature, or... Continue Reading

White House May Be Satisfied with IRS Non-Answers, But Targeted Americans Aren’t
At a press conference on Wednesday, a reporter asked White House Press Secretary Jay Carney a simple question: Is the administration “satisfied with the responsiveness” of Internal Revenue Service officials who have been called to testify before Congress? Before we take a look at how Carney answered that question, let’s recap what we’ve learned from IRS testimony about the scandal. As I explained last week: Former IRS Commissioner Douglas Shulman testified that he didn&r... Continue Reading

The IRS and President Obama’s Ongoing Targeting of Conservative Groups
As the IRS continues its unconstitutional targeting of conservative citizen-led groups, President Obama (who unquestionably knows about the targeting now) has done absolutely nothing to stop it. It is an ongoing atrocity – a mockery of any semblance of justice in our constitutional system of government by consent of the governed. To understand how the IRS targeting is still ongoing to this day, it is important understand how this IRS scheme worked. First, conservative groups were invidi... Continue Reading

No Mr. President, It’s the Terrorists Who Will Never Win this War
Last week President Obama gave a speech – as he is fond of doing – significantly altering the national security of America. Among calls to close GITMO, end the Authorized Use of Military Force Against Terrorists (AUMF), and ignore the threat posed by al Qaeda, President Obama said something that cuts against the very core of America. He essentially said we can’t win the war on terror. At no time in our history has an American President ever said we can’t win a war we w... Continue Reading

IRS Testimony: Arrogant and Embarrassing - Federal Lawsuit to be filed Next Week Against IRS
It was a very troubling hearing to watch. Acting IRS Commissioner Steven Miller, who is leaving his job about three weeks earlier than planned, appeared before the House Ways and Means Committee today to answer questions about the ever-expanding scandal at the IRS - the decision to target hundreds of conservative groups - unlawfully focusing on them because of their ideological beliefs. Miller had nothing to offer. Nothing to help shed light on this very intrusive intimidation scheme carried ou... Continue Reading

IRS Scandal: Time for Independent Counsel
President Obama continues to fail to show leadership as this IRS scandal continues to expand. The resignation of acting IRS Commissioner Steve Miller does not solve any of the problems of this tainted and politically-driven agency. The announcement comes just hours after the IRS attempted to blame this abhorrent conduct on a couple of rogue IRS agents out of the Cincinnati office. The American people and our clients deserve much more. There are many questions that President Obama failed to add... Continue Reading

How about a “Do Over” for the HHS Mandate?
Judging by critics’ reactions to the Obama Administration’s latest tweaking of the HHS Mandate, you have to wonder whether the bureaucrats who created the mandate wish they could go back and start over again. To begin with, the Notice of Proposed Rulemaking (NPRM) issued on February 1, 2013, makes no attempt to address the objections of for-profit business owners. So far, for-profit employers, relying on the Ted Kennedy-sponsored 1993 Religious Freedom Restoration Act, have been succ... Continue Reading
